I looked on my Experian report today and they are still putting the defaults on every month even though it's stayed in court due to them.
Are they allowed to do this or should I be getting on to Experian to remove them?
We are having the same problems Joe. OH's c/card alleged debt is made up entirely of penalties, we won the case against them, they didn't pay up and case for restoration on 28th September stayed. Mercers still ringing, you could try writing to Experian to explain but try reporting to TS, haven't got around to it yet but intend complaint to fos and OFT. Think Bcard must need the money more than we do -
So Bcard lost and told to pay you and they didn't, that must be contempt of court at least.
I have found out from other sources that when they issue the court papers it automaticly puts the account into dispute and they are not allowed to update your credit report until a judgement has been made in the courts.

I would apply for the stay to be lifted especially if they are using test case as that is for bank overdraft charges and nothing to do with credit card charges. Also the case was won prior to test case.
I would address a letter to the Data Controller at Barclaycard asking them to remove the information and show the account as in dispute. Copy it to the CRAs. If no joy you can then possibly look at complaining via the Information Commissioner:

Thanks all for your helpful replies - bit financially challenged to try to lift stay and OH went into Hosp for op, but will certainly complain, they are a disgrace aren't they?
