Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Today i have received a letter from Red Debt Collection services, offering me and i quote,
'I am in a position today to offer you an early settlement figure with a discount of £1173.49, leaving a new outstanding balance of £.'
I say that is outstanding, i owe them a decimal point. Should i send this on headed note paper or will normal A4 be adequate?
Seriously though,
I have received letters in the past weeks from Lowells trying to claim this money from me, and threatening me with a doorstep collection.
After reading about people in similar circumstances i just thought i would get peoples take on my situation.
After checking my credit file i found that there is an account with a default against it relating to an old Egg credit card that i had totally forgotten about (and am not sure what i paid off, or didn't pay off). It dates from a period of my life i would like to forget about, a lot of difficulties all at once.
The credit file shows that the acc start date was 21/05/02, acc closed 15/01/2003, and last updated 10/11/03.
So far i have not acknowledged any of their letters, and was going to send them a CCA request.
Also forgot to mention, on the Lowell letters they have stated what address the debt had been registered to and:
Wrong house number-states a flat number?
Wrong street-spelt incorrectly
Wrong city- again spelt incorrectly
Are these people employing trained monkeys?? (In fact if they are, well done monkeys! because they nearly get the address right). If however they employ a normal staff have they been to school?
Ignore them in the meantime. They are trying it on for what will soon become a statute barred debt. They havent your details correct so why should you enlighten them. The debt may well be statute barred as the account was closed in Jan 2003 and probably no payments made for a few months before that
They have only made a mistake on the old address, the one that that the debt had been recorded at. They have my current address correct.
If the account closed in Jan 2003, does that mean the debt will be statute barred in Jan 2009.
If however there is a chance that the debt is already statute barred how can i find out, or will finding out upset the apple cart and lead to them stumbling on original credit agreements etc?

The account will be Statute Barred 6 years after your last payment or written acknowledgement of the debt. You could send Egg a cca to see if they still have the original agreement (I have to warn you that EGG seem quite good at keeping documents) . An SAR to Egg would show all the details they held on you and should show last payment made to them.
I would ignore Clownells for the time being and see what next they come up with. It looks like the chimp on the computer has pressed the wron g button. Hold on to their letters for your records. They appear to have written off the whole balance by mistake
