HBOS faced with winding-up order

HBOS now has to fend off a winding up order

HBOS, the UK's fourth-biggest bank, is being threatened with a winding-up order for failing to repay some customers' overdraft charges.
A claims management company, Robertson Holbrook, says it will take the action because the bank has ignored judgements made by Cardiff county court icon

Ten of the bank's customers are owed a total of £45,643 after HBOS failed to defend their claims in court.
However, the bank said the threat of being wound up had no merit.
"We have received the letter and our legal team are currently reviewing it," said a bank spokesman.
"We have not ignored the claims and we will be telling Robertson Holbrook that very shortly."
HBOS said it had already paid more than £21,000 in the claimants' accounts and that it had no record of any judgements against it.
Claims
Robertson Holbrook, a claims management firm registered with the Ministry of Justice, has taken on about 3,500 claims against HBOS alone.
The 10 claims in question - ranging from £1,900 to £8,400 - were heard at Cardiff county court in early August and led to judgements against the bank when it failed to turn up to defend them.
The bank has yet to pay up, so the claims management firm will now start winding-up proceedings to get the money.
"We will serve the papers on them today or tomorrow," said spokesman Tim Russell.
"We have to get them up to the head office in Halifax," he added.
Asked why the firm was not simply sending in bailiffs icon

Winding up
Under the Insolvency Act, winding-up will start if the HBOS does not comply with the Cardiff court judgements within 21 days.
Mr Russell said there had been absolutely no response so far.
"It is the arrogance of them, putting themselves above the law, it is so frustrating."

have made visits to the HBOS headquarters in Halifax before, in pursuit of other claims, but this is thought to be the first time it has been threatened with a winding-up order. Marc Gander of the Consumer Action Group said: "The pattern of the bank's behaviour is completely in line with our experience. "They have been obstructive and arrogant, both of the customer and the legal system."
