    Default Egg Credit Card Threatening Default

    I have just recieved a letter from Eggicon stating that they will accept my offer of reduced payments but not suspend interesticon or charges and they have said they will issue me a default notice as i am no longer complying with the termsand conditions of my account can they do this as i have not missed any payments just reduced payments to which thaey have accepted they have also cashed the cheque that i sent with the reduced offer of payment?
    what are the rules of default issuance?
    I am also wring a letter back for failing to suspend interest and charges.

    Seems a bit harsh if they have agreed the reduced payment surely that must equate to a both parties agreeing, and not be concluded as breaking the terms of the agreement?? if i did not pay anything or did not write to them, then i would agree that would be in breach of the aggreement.

    Sequenci is as usual correct - Eggicon are bu88ers and as so many of us are taking them on they don't negotiate anymore.

    I recommend that you go down the CCA route and ask them for the agreement Creditors and DCAs - Letter Templates & Budget Planner letter N and in the letter ask for all future contact to be in writing, if they ever call you state you asked for all contact in writing and put the phone down never talk to them. This puts the debt into dispute and Egg can't do the following

    a. may not demand any payment on this account, nor am I obliged to offer any payment to you.
    b. may not add any further interesticon or charges to this account.
    c. may not pass this account to any third party.
    d. may not register any information in respect of this account with any of the credit reference agencies.
    e. may not issue a default notice related to this account.

    When they send the agreement, often beyond the timescales allowed, it does not have the T&Cs included, a further request for these gets you supplied with their standard set of cr*p.

    The bottom line is that, the agreement & T&Cs as supplied are not linked, over 2-3 pages, often have differing fonts, all of which creates reasonable doubt as to whether the agreement is enforceable or not - only a judge can sort that out

    Over the whole period of the above you can stop payment after 12 + 2 working days they will have defaulted on your request.

    After a further 31 calender days they will have committed an offence and you can start complaining to their local Trading Standards, The Office of Fair Trading & when you get their final response letter Financial Ombudsmanicon as to their breached of your consumer rights.

    I'm not an expert so check everything I tell you, however click me scales if I've been useful.
