    • I would have thought so but I'm no lawyer. What did the one that you spoke to say? You could also google about how/when a will trust is set up to get more of an idea before you speak to the original lawyer. HB
    • While I am waiting for the original solicitor to ring back about the will can I ask. After my dad passed they were informed about this an released a copy of the will to me and my brother, should they have set the trust up then as they were informed of his passing?   Thanks again

The MP, who is one of Rishi Sunak’s trade envoys, is also said to have called his 78-year-old former campaign manager at 3.15am one day in December, claiming he was locked in a flat and needed £5,000 as a matter of “life and death”.   Hes supposed to use funding from Taxpayers and doners for a life of service, not funding a life of drink and debauchery Hope his parliamentary expenses are also investigated.   In fact, perhaps Mr Bates next role in life should be as an independent investigator of Parliamentary expenses?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Back in 1998 (and possibly other periods as well), Barclaycard were in the habit of sending out pre-approved application forms for their cards.

 

Quite apart from the fact that they didn't have my permission to check my credit records to see if I was credit worthy, it would appear that they might not have been as diligent as they should have been, as my credit record was pretty dire at the time.

 

Anyway, there are a couple of issues with this. Firstly, there only ever was an application form, with no agreement to follow it up. And no interest rates mentioned, credit limit etc. That all to be decided when they send you the card.

 

Now that leads me to believe that, as they claim the application form WAS the agreement, then as no interest was stated, then they had no right to charge any interest. SO might that also be recoverable in that case?

 

The second point is, in my case at last, there was a box to tick if you consented to Barclaycard sharing your data with anyone else. (In my case, I chose not to tick the box). Now it might be argued that this meant sharing data for marketing purposes. But it didn't say so. And indeed, in the T&C's that I have been sent which purport to have been in force at the time the APPLICATION form was signed, Barclaycard state that they will not pass your data to anyone else WITHOUT ASKING YOU FIRST.

 

That leads me to believe that they had no right to pass your details to the CRA's oranyone else. Including, IMHO, Mercers. Mercers may be part of Barclaycard, but are as far as I know, a seperate company in their own right. Therefore a third party as far as the DPA is concerned.

 

So if anyone else has had a card issued about that time, in response to a pre-approved application form, it might be worth questioning whether or not penalties and charges, and INTEREST might not be claimable also.

Barclaycard also sent me a barely legible copy of an application form they tried to pass off as a credit agreement, that was in April. Strange I haven't heard from them since, and I didn't tick the box either!!:mad:

 

I applied in 2000.

L/Woods B/Card/Cabot - Unenforceable CCA, SD Issued *WON+COSTS*

Capital One/Cabot - No CCA account irrecoverable.

Citi/DLC Hillesden - No CCA account irrecoverable

MBNA/Aegis - Unenforceable CCA

B/Card/HFO - Unenforceable CCA

OK, TWO breaches of the DPA. I've just got home, and Barclaycard have stated that the only data they hold on me are statements from 2001.

 

So how did they manage to supply Cabot with default notices and an application form?

 

ICO complaint form being filled in today. I'l carry the story over onto my resurrected BC thread here...
