    Default Problem with 3

    I had a contract with 3 while I was on leave having a baby 2 years ago .It was not made clear about the charges at the time . When got my bill I was not happy as there were additional charges. At the end the bill was over £200 and it went to DCAicon where it was agreed I could pay 10 per month until my sitution changed. Due to ill health i forgot to pay and now 3 have taken bac the account and are seeking legal action. I have had nothing in writing from 3 or even the DCA. I found this all out when I made a call to make payment. I spoke with 3 after making the payment who said its not there problem that Im on benefit and my offer of £10 is not enough and want more. I am in the process of writing to 3 but im scare of the out come.

    Any advice would be great

    This might be better in the debt section.

    As long as the offer you are making is the most that you can realistically pay under the circumstances, 3 have to accept it as in the unlikely event of them taking you to court all the judge will do is look at what you can afford and order that.

    There are a number of template letters in the debt section that should help you (just ignore the CCA ones as they don't apply to this debt).

    Also from now on do not ring them to discuss the debt. Make all dealings in writing that way you cant be bullied into agreeing a payment greater than you can afford. If they ring you, tell them you will only deal in writing. If they continue to call fire off a harassment by telephone letter also found in the debt library

    17/10/2006 Recieve claim against me from lloyds TSB for £312.82
    18/10/06 S.A.R - (Subject Access Request) sent
    03/02/07 Claim allocated to small claims. Hearing set for 15/05/07. Lloyds ordered to file statement setting out how they calculate their charges
    15/05/07 Lloyds do not attend. Judgement ordered for £192 approx, £3 travel costs and removal of default notice
    29/05/07 4pm Lloyds deadline for payment of CCJ expires. Warrant of execution ready to go
    19/06/07 Letter from court stating Lloyds have made a cheque payment to court
