    Default Litigation- Requesting Documents from Defendant

    Hello,

    I have a court hearing on 10th October, which is the culmination of my litigation with Sainsbury's Bank over unlawful charges. I have been asked to furnish the court with a number of documents as part of my 'bundle'. I have most of these to hand, however, I do not have a copy of the original credit agreement, which I imagine will be necessary, evidentially.

    I have written to Sainsbury's asking for a copy of this in accordance with the CCA, etc., however they have not responded. Time is now running out- what should I do? If I don't have this document in my bundle, will it harm my case? Ought I to write to the court explaining what has happened? Any help appreciated.

    Include in your cover letter a statement saying you don't have possession of a copy of the credit agreement or terms of the account.

    Add that you have issued a consumer credit act 1974 s77-79 request on the defendant to obtain this information, which they are in default of.
