    someone said to post here as i need help.hi, wondered if anyone could help. i am a carer for my disabled wife and mentally disabled daughter. i used to work when my wife was my daughters carer but now she is ill and in wheelchair i care for both. well when that happened everything went topside as loans i had and other bills started to escalate into arrears. the first on i want to tackle is this b/card.
    i do not have the card anymore as they have taken it away from me. im in debt to them. they have not passed me to a collector but collect it themselves. i have cca them. i recieved this back.
    could someone have a look. thanks.

    arrears under special arangement £22.31

    you have not kept to your payment arragement agreed on the 24/10/06
    you must telephone us imediately on the above number to advise us of your intentions for repayment.

    if you fail to keep to future arangements we will have no alternative but to pursue further action.

    Ken, as a basic what they have sent you is total garbage

    The T and C's sheet might well meet the prescribed terms of the consumer Credit Act 1974 (Sections 60 and 61) but thatis not the document you have signed

    The doc they have sent is an application form and NOT an executed agreement, hence under section 127(3) a court is not allowed to enforce it

    As stated above, if we can get this moved to the Barclaysicon forum and then get the main CCA thread bods looking it over we can pick it to pieces

    thank you so very very much everybody, i was getting worried as noone replied on other thread and someone kindly sent me here. i really appreciate the help. sorry if i dont post till late but hands are very full at times and dont get much time.

    but with the leter dated 16/8/07 im a bit worried as they state procceedings will start.

    dont now what to do next.

    For a start- Dont Panic.

    Things dont happen that fast. They MUST follow certain guidelines to enforce this, any court action is months off and they are just trying to bully you.

    Three questions-

    Have you recieved any letters or phones calls from a company called Mercer's Debt Recovery?

    Have you recieved a Default Notice?

    Have you been informed of a default being registered with credit reference agencies?

    Fourth and VERY VERY important question:

    Do you have your statements for this account- if not have you sent them a SARicon in order to get them?

    Please just answer these questions, it will make it easier to help you.

    Remember rule 1- Dont Panic.

    If your statements contain penalty charges for late payments and going over your credit limit you can claim these back as well as the interesticon you will have been [problem]med into paying on the charges.

    This will reduce the total amount you may owe them. It may even be more than you owe them. In ither words, they may actually owe YOU money.

    But dont get ahead of yourself and calmly answer the questions above.
