Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I ahev a topshop account card with a credit limit of only £250 but I have never been able to get away from this limit because of all the charges that they have put on the account. I have every statement that they have ever sent me, so can I go ahead and claim without having to send off a DPA or should I do it anyway to get evidence of manual intervention (or lack of) it seems this bank are quite hard to deal with!
I estimate that what I am owed is at least and probably more than the amount on the card, so could i just demand that they wipe out the debt or is it better to do it the conventional way and just use the money gained to pay off the card?
If you know how much you are claiming for, I would just send the preliminary letter otherwise you are waiting 40 days for the DPA stuff to come through (and it saves you a tenner )
I wouldn't ask them just to wipe the debt, I would want a full refund of all charges and then you can clear the account with those. It might be that they say they are closing the account anyway and just send you the remainder. That is what I expect Nationwide will do with me.
Please note that I am not a legal expert and all advice given is without prejudice and is purely my opinion only.
