    Default Dept of Work & Pensions - Iqor Debt Recovery - Serious Help Needed Please!!!

    Hi all,

    Received a white card with a phone number asking me to call urgently which I did. When I called I found out the company was Iqor Debt Recovery and that the card was regarding a debt with the DWP for overpaymenticon of Jobseekers allowance from 29.10.03 to 18.11.03!!!

    I told them that I had spoken to someone at Iqor on 05.07.07 regarding this "so called debt" and that I had disputed it because I cannot remember back that far plus I was not aware that I had been overpaidicon. The women said she would send these comments back to the DWP as I requested evidence of this debt in black and white.

    Back to this evening's call, the gentlemen I spoke to was very rude and wanted me to pay there and then. I told him that I wasn't going to pay for something that I wasn't sure I owed. He then said that the DWP, being a government agency would send bailiffsicon round and take me to court!

    He said he would put notes on the "system" but that action could still continue. He also said that when my last call in July was reiterated to the DWP they apparently confirmed the debt yet I have nothing in writing.

    Can I request evidence? Can they send bailiffsicon round? Do I have a leg to stand on?

    I mean it's taken them nearly 4 years to get hold of me yet I have been at my current address for 3 1/2 years, on electoral roll and have been paying council tax?!

    OK first thing NEVER telephone, especially from a postcard through letter box!

    next they CAN'T send bailifs before court action.

    best thing i'd guess at is to WRITE leeter to them (recorded delivery) and ask for proof if they refuse let them take you to court,

    in same letter TELL them you will only correspond in WRITING ONLY. shoud you ignore you will be in breach of telecommunications act 2003 S127 and you will report them to OFT as they in breach of DCAicon guidelines set out by OFT.

    i gotta ask were you on job seekers allowance at any time? if so might be worth contacting job center or alikes,

    anyone else suggest something that might help?

    Are those dates correct that you posted?

    If they are we are talking 19 days of JSA which is about £150 say

    they chase this after 4 years when the system is being defrauded out of millions look at the child tax credit website being [problem]med for £££££

    this sounds crazy

    Anyway, write in and dispute it, make it clear that you need to see evidence...

    when ever DCAicon's are involved you MUST keep everything, even record phone callsicon should they phone you, if not note date/time/contents of calls (should it be required later on in your defence:grin: )

    It's for them to prove that the debt is owed, not for you to prove that it isn't.

    I am amazed that the DWP have involved debt collectorsicon - after all they have the power to do earnings attachments and so on to recover overpayments. Anyway, if the overpaymenticon is their mistake they can't reclaim it anyway - comes under the umbrella of 'official error'. Sounds extremely weird to me. I would have expected you to have received at least one letter (!) Fight it all the way is my advice.

    That's a slightly different - but similar situation if that makes any sense!!

    I would guess you don't receive any benefits at the moment or they would most probably just help themselves, the alternative now is DCAicon's apparently.

    Ask the DWP for evidence of this 'debt'. They will have to prove it, and there will be pretty comprehensive records from that time. If they've made a mistake then it's not your problem.

    Don't worry about bailiffsicon and all that stuff. That is a long, long way down the road, and it's highly unlikely it would ever come to that.

    Update on current situation:

    Spoke to a "Customer Service agent" at Iqor Debt Recovery. I explained that as this debt was nearly 4 years old ?! I wanted to dispute it as I was not aware that I was overpaidicon Jobseekers Allowance.

    What annoys me is that I had not idea this supposed "overpaymenticon" existed until Iqor contacted me a few weeks back which means that the DWP sent it straight to a debt collectoricon.

    Anyway, I told the agent at Iqor that I wished to see a statement of the facts and to see how the amount owed has been calculated. I stated that this was my right under the usual acts etc etc....

    She then told me that she would raise a dispute with the DWP.

    I'm still not any clearer on what is happening as have had no contact in two weeks!

    Ask the DWP for evidence of this 'debt'. They will have to prove it, and there will be pretty comprehensive records from that time. If they've made a mistake then it's not your problem.

    I am new to this site nd dont mean to sound rude but something you have put is wrong, l no this as l am trying to get the DWP to sort something out from 2002/2003 when they closed down my partners and my claim for no reason.

    The correct information is yes ask the DWP for evidence of this 'debt' but be expected not to get it as they destroy all paperwork regarding benefit claims after 4 years, This is unless it is part of a overpaymenticon which they are currently taking out of your benefits.

    As l said earlier l am trying to obtain information from them dating back even further than you and have been told that all paperwork from then has been destroyed under the dwp policy of not keeping relivant paperwork for more than 4 years. I have found it very difficult to get anything regarding the paperwork l need but it may be on there computers but every month it is backed up and put in storage which is then moved to remote storage after 3 yrs.

    I wish you luck with gaining the info you require and remember if they cant prove you owe them money then you DONT owe it

    I was in a similar situation a few years ago. I got in touch with DWP & insisted that they sent me copies of the relevant claim. It took them months to respond...but eventually what paperwork I did receive served to prove the error was theirs anyhow.........Oh yes, the amount involved........the princely sum of £14.80

    Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.

    Hello Everyone,

    I have had so many letters from this company called IQOR they are THICK, RUDE, IDIOTS and brainless. Why do you ask?

    I owed ebayicon a tiny amount of fee like under £5.00 which I did pay them but I was a month late due to the fact I was away, then got letter after letter after letter from this company IQOR treating me and saying they will send out people to my home and take my goods. Well I had a good laugh as I did pay ebay when I got back. And ebay said they will contact theses people and tell them just that. Well after 1 month I am still getting theses letters from Thicko IQOR saying all sorts and giving me 72 hours to pay.

    They are asking for £8.00 silly idiots. it's costing them to send out theses letters. What can I say apart from do not use ebay ever again. As if they use such a company in the first place, that should ring bells with everyone should it not?

    So now I am having to see my lawyer so I can take them to court and get what I can from them. And I am going to so loveeeeeeeeeeee doing it lol. I might even send them a hapy xmas card this year just to rub salt in the cut hehehe.

    Don't be scared of this comany play them at there game. Even if they say to you that you have or are defaulting on there agreement. If they say this to you, then you ask to see the actual agreement in writing within the next 7 days. then they will shut up and maybe leave you alone.

    dont want to put spanner in works but i know from experience, that being overpaidicon by any government dept...does not ever come under the umbrella of official error...that said they have to provide proof that the overpayment did occur...make sure you question everything and best of luck
