Since the start of the year I have made a conscientious effort to budget and ensure that all of my financial affairs are handled In such aware that I don't incur penalty fees. For eight months everything had been going swimmingly
On Thursday I bought a TV using my A&L Switchcard. Due to an error with the chip and pin machine the amount of £x.xx was taken twice, but in their defense of the retailer the error was corrected once it was it brought it to their attention a couple of minutes after the transaction was made.
Being a rather large sum of money I checked my available balance the following day and the refund was showing on my end balance, but with another transaction that had taken place my account was £0.02 overdrawn. Knowing this I paid in via my local branch the following day, a amount of £x.xx in cash to bring my account back in line plus a little extra just In case.
SO you can imagine my surprise when I checked my balance this afternoon to see that for the period I was £0.02 overdrawn I have been charged £25, PLUS there is another charge of £25 pending on my account!!
Alliance and Leicester have said that they will not refund these charges as they have been instructed not to by the fos and FSA (their exact words), and I should be adult enough to accept the consequences when i allow my account to go overdrawn. X10!
I'm not one for making threats but when I said I was taking my business elsewhere the woman on the other end of the phone said "well Sir that is your choice"
What the hell is happening to this country........

Talk to them again , they have to be reasonable about this. Its outrageous, anyone can see, even them! This has happened to me and they did refund me the charges. However things got from bad to worse with me, ending with me closing the account.
Then when I heard about re-claiming, I started on the CAG road and ended up (allbeit 6 months later) getting a settlement of near on the full amount!

I can say from bitter experience A&L wont budge on this. It seems all the bank staff are quoting this OFT case for every query.
Also if you have already had charges refunded by A&L and try to claim again they will close your account. I was told by an account manager that even though I had run my account well because I had charged refunded 125.00 and then incurred a further 25.00 charged (Due to their error). I did not abide by the T and C's and they closed my account.
I have refused in principle to pay this further 25.00 since the account has closed and more and more charges are being added!
They keep sending me snot o grams and have now passed the account to a DCA!
Even though retaliatory account closure is being investigated by the FO.

It wont cost much to try another phone call as you know how much hassle it is to reclaim it, you never know!!
I know how frustrated you are but dont mention anything other than how "great the service that the bank provides is" or mention "how happy you are to be an A&L customer"

You can squeak as much as you want, you might meet a person who really is HUMAN, and will see things your way. If you do, count yourself lucky. But the MAJORITY are all passed thru the same machine and you might as well bang your head on a brick wall. If it's any consolation, I have an old switch account with Halifax, in which I keep a trifling amount of money, it's kept there because I got my fingers burnt in the past, plus you never know when you need a £ or two. The other day I decided to get a 'mini statement' to check my balance, I was 2 pence overdrawn, how come? My son, finding himself short, had charged something to this account. I explained to him that as I had gone overdrawn I could expect to pay a further £30. He could not believe that this was possible, he now does, as the letter arrived yesterday. As he is only just starting out on his journey of life, watching me and the effect bank charges have had on our lives, has had quite an effect on his outlook in general, he has 4 years of University in front of him and is dreading the thought of becoming another piece of 'Cannon Fodder' for the bank's to chew up and spit out.
The problem with us English is we are too Polite to speak our minds, let's take a leaf from our overseas friends and start speaking up for OURSELVES.

Prelim letter requesting repayment of charges was received by A&L 12/10/07, standard reply received 17/10/07 stating that all claims had been put on hold due to Test case.
Total charges incurred - £150 for going overdrawn by £0.02!!!!
Personally as which ever way you go at the moment , cases are going to be delayed you might as well think about filing a complaint with the fos - they will only process or help people with genuine hardship cases at the moment - but your case will be on their " waiting list" and for the amount you are claiming you may be better to go this way?
Maybe if they build up a huge backlog of complaints and the case drags on it may persuade them to think again about the waiver.
Also let A&L know that is what you are doing - but that you will be willing to resume court action if the waiver is lifted .

Hi guys. Im new to here but I have had the EXACT same instance. A bill to myslef in another account was paid twice for the same amount, same date etc (so clearly an error) and I even went into the branch that day and cleared it. I was advised by a member of staff in front of me who wrote on my statement after agreeing with another manager at the call centre to have the 'charges waived' funnily enough they never were and luckily I had the funds sorted because they didnt tell me, they just took it from my account. 3months on, I had the snottiest little girl tell me over the phone to 'do what I want, speak to the FSA if you want'. I know its only £25 but the principles! As with you all, I was told today 'your complaint will be on hold till we resolve the high court case, and to be honest you wont get anything back'. This is disgusting, and I have a LOT of savings with them, but if I remove them I forfeit interest so its lose lose. I used to work in financial services and it has gone downhill so fast.
Prelim letter expired 5/11/07, lba posted 6/11/07 and A&L replied with a standard letter today just again saying how sorry they are that I've had to complain, test case, FSA etc etc.
I'm going to wait until 30/11/07 before I submit an N1 to my local court.
