    Default Barclaycard

    Hi, I have a barclaycard debt, I am having difficulty paying at the moment, and Mercers are sending letters of default etc.
    Can I ask barclaycard and mercers for proof of debt?
    Is this adviseable?
    This account has been open for over 8 years.
    I have always tried to pay, also had SARicon sent out to them , but they just keeping lumping charges on.
    Help please

    Yes, in fact it is advisable to do this. As you have already sent a SARicon to Barclaycard, send a CCA request to Mercers. This should put your account on hold for a bit until you get the results of your SARicon.

    Send the CCA request recorded delivery with a £1 crossed postal order. do not signicon the letter. A template for the request is here http://www.consumeractiongroup.co.uk...templates.html template N.

    OK my cca went out tuesday to B*stardcard only from USA.
    But Im moving back to the UK soon.
    Should I wait until IM back in Blighty to start SARicon up again and then claim charges back.?
    Im a little worried that I cant get a mortgageicon because of all this bs from B*stardcard and Mercers.

    Really you can only claim the charges back if you acknowledge the debt so it is a good idea to see:

    1. Whether they send you an enforceable agreement (unlikely)
    2. Whether the charges plus interesticon will come to more than the balance outstanding.

    I assume your problem with a mortgageicon is due to a default being placed on your credit file? If you don't know whether they have on not you need to contact Experian and Equifax to get your credit reports (costs £2 from each).

    As you are moving back to the UK soon you may wish to wait until then to send the SARicon as it can take some time to receive this information. They are allowed 40 days to supply it but it can often take longer.
