Hi allI sent a cca request to Barclaycard on 23/4/07. They cashed the cheque on 1st May.The 12 days plus 30 days then passed which as on 11/6/07Sent a reminder and advising that I will no longer make repayments on the account - this was sent on 1/8/07Today I have received a copy of my application form I filled out back in 1995.It very clearly states Student Application.It has my signature and has been dated by me.They have also sent me a copy of the "Barclaycard conditions of use" leaftlet.The letter they sent me says "Please find enclosed information as follows. A signed copy of your Appliaction Credit Card Agreement regulated by the consumer credit act 1974.A copy of your Barclaycard Conditions regulated by the consumer Credit Act 1974.This information enclosed completes our obligation to supply and copy documents under the consumer credit act."What do I do next. I have still continued to pay them but was not going to make the next months payment.Should I still stop the payments? What letter do I now send to advise them that this is not the credit agreement but it is the application form.
There are certain things that need to be one there before it is enforceable. Just because you applied on an application form does not mean that you were accepted. There are posts on here advising whether the document you have received is enforceable (http://www.consumeractiongroup.co.uk...le-useful.html) Maybe you could scan what they have sent you so someone more knowledgable can help you...

Don't reply to Barclaycard until you are sure that what you have received is a credit application rather than a fully executed copy of the original credit agreement.
