i am fedup with barclay card, to sum up the limit is 300 and so far they slapped 600 odd in charges on.
most of these charges go back before OFT stepped in.
last time they passed to mercers who issued a default.
they said pay sommit and they pass back to barclaycard, of which they did
i try make regular payments, example, 180 over 3 months (60 was a refund for non compliance of DPA) BUT i noticed they still chargin late payment fee. on the third month of makin payments they decided to phone, I asked why they chargin late payment they said I am 1 month in arreas. this is new excusse to add charges.
I will point out now that the card expired in dec 2006.
anyway I had enough and told barclay to get stuffed, I now receive letter from them PAY UP NOW or we instruct Mercers to default you.
I read some where on CAG that you can't LAWFULLY be defaulted on the same account twice. I need to find an act or sommit that confirms this so I can put another nail in mercers/Barclays coffin.
I will be issuing a lba to barclays over next couple months in case you might ask.

Write a proper letter requesting the unlawful charges be refunded as your lba - use a template from CAG do not rely on your own grammatical skills. You can only be defaulted once per debt but they may not have defaulted you properly first time round.
lol i do my letters properly thankyou it will be end of next month b4 court action so i'll hold off lba for 2 weeks. can't wait for mercers to start banging on the proverbial door
update. months later lol. it's still going on and it's dead locked,
last time i bothered to look outstanding balance was £800 odd, tickles me as the credit limit was only £300, been 3 months since any contact from b-card/mercers, never did get an agreement out of them from SAR

If the SAR didn't work, have you considered sending a CCA request and seeing if that ellicits a response.
That would give you the chance of default removal if they have no proper Agreement.
That may be a better option than reclaiming your chgs which would still leave you with the default and a balance owing to BC because of chgs and int't.
