I have today received a letter from Cobbetts with a copy of their defence quoting the OFT test case and enclosing a copy letter that they have sent to the court requesting a stay, but this is a credit card claim....

Surely they cannot be getting away with submitting the same old paperwork for all the claims that they receive?

    Any advice would be appreciated...

The OFT test case is not about credit Cards.

Should not be allowed to get a stay.

Hope someone will come along in the same position as you, to offer advise.

On that note bumpity bump for you.

    Kindest regards

    Dee

Latest news is that the stay was granted by MCOL - I sent them a pretty strong email pointing out that this claim was for Credit Card charges not "overdrafticon charges" as per the defence that Cobbetts had submitted and that this was clearly an abuse of the courts process.

Had a very nice email back from MCOL to say that my case has now been transferred to my local court so watch this space.....

    Hello

My total claim with RBSicon Credit card (Mint) is for £125.95 and I have today received an offer letter from their Solicitors offering me the sum of £85.00

Is this the usual way of things with RBS?

Absolutely just reject it then face them up- they took my son all the way to 4 days before the proof then paid up- this was Scottish procedure and for credit card charges
