can any one offer some advice on my situation please
i purchased a two seater and three seater leather recliner sofas from LOL and they are faulty, they are only 2 weeks old and i reported the faults immediately, the day after they were delivered.
they have messed me around since so i put my legal head on and demanded my rights under the Sale of Goods Act 1979 as amended and they sent someone out yesterday to look at the sofas.
anyway i had a call from some jumped up salesman at my local store saying they couldn't guarantee a repair so they would offer me a replacement or refund. i said i would accept a replacement and they said ok we will send someone to collect teh suite tomorrow to which i replied " so you will bring me a new suite?" and they said NO we will get you one on order which will take 6-8 weeks atleast.
surely this isnt right is it? i thought they had to replace the item when they collect it.
any way can anyone offer some advice as i cannot be left without a seat as i have recently suffered a back injury and need somewhere to sit.
i also want the sofas that i brought and dont want a refund
I fully concur with the post by Darren he has it 100% correct.
Push them and send all correspondence in writing (recorded post) to the store and/or the head office in Kent. If you have a fax it is cheaper.
Keep a record of all telephone communication.
You will not be happy with Land of Leather or any product they supply. You are at the start of a very frustrating dispute as they will mess you around and stall with no regard for you. They will also hang onto your money for as long as possible.
i am currently locked in an arguement wiht LOL over a replacement suite, they are saying that they need to remove my suite now and i wont get a replacement for 8 weeks, ive argued that it is an unreasonable amount of time and not as required under the S.O.G.A 1979
im not too worried though as my tutor who's a very experienced barrister has got involved and is helping me with the letter writing side of things so fingers crossed
The argument over the collection of your faulty suite and the subsequent replacement is a stalling tactic in itself. They know it is unreasonable and they also know it will drag the dispute out. You have a fualty suite they have your money.
Act quickly and expedite the matter to resolution. They will stall and delay and try to drag this on.
I paid my money to Land of Leather in February 2007 and it is now in the court process.
Take advantage of my experience and avoid these delays.
Glad I found this thread, my son bought 2 leather recliners from LOL about 9 months ago, there is a problem with the recliner on the 2 seater (it wont work), hes complained to LOL but hes still waiting for someone to come and see the problem, also hes worried that they might take it away and not provide him with a replacement for months, he bought them on 12 month interest free so been saving all year and ive got his cash to pay for them before the interest period expires, however dont want to hand over his cash if they take his faulty setee away for months, but also dont want them to add on all the interest if he dosent pay in time..
