In or around 1996 we had both a Barclay card and master card, most of the time we payed in full but not always on time so there is a large amount of chargers on the card for late payments
in 2001 my husband took up a offer of a vodafone Mobil phone with them, this was the worst thing he had ever done as the bills where staggering and each month Barclay's would just take the payment from the card, after 12 months he decided to ditch the Mobil phone and get on from another provider, this is where chargers started to be added to the account, firstly vodafone informed him that the Mobil agreement was with Barclay's not with them so he needed to canceled with Barclay's no themselves when he tried to do this \Barclay's would bounce him back to vodafone. my husband called Barclay card and informed them that he wanted no more payments coming out of his account to pay vodafone as he was now in dispute with them over there charges and he wanted to make alternitive arrangments for the way he paid the phone. Barclay card ignored his request and continued to pay vodafoner with out his agreement so we now have a outstanding balance of about 2000 which we totally dispute owing, In 2004 CAB wrote to Barclay's because i was very ill and asked them to reduce the payments which the have to £1,00 a week but because of the size of the repayment I kept forgetting to pay it so we have never payed anyway towards the debt. I am almost sure this debt is mainly made up of interest chargers, late payment chargers and the phone bills that we wrote asking them not to pay. what should I do.
should I leave well alone because they are not hassling me for money.
Should I send the 10 pound and SAR letter and fight the chargers. I would calculate about 5 £ in chargers between both Barclaycard and master card visa. If I cam unstuck and had to pay the full balance I could do.
so what should I do
any advice please. I am getting bord now i have won my bank chargers claim and need something to get my teeth into.

Hi MH. thank you for your reply. my one worry was if they had wriitern the debt off whould i be opening a can of worns but saying that the debt was in dispute anyway because of the mobil phone payments. I have since found the original contract for the phone and i was in my rights to cancel the contract after 12 months so barclay's should have stopped making any payments to them when we wrote requesting all payments to be cancelled. but to be honest I would rather have it all cleared up even if i do have to repay them.

I would post this across in the general debt forum as well - they are much better informed at this type of thing. You may find that there is a quicker route through a CCA or similar.

Did you cancel the payments in writing ?
About 10 years ago i tried to cancel a Company Barclaycard over the phone, they said i had to do it in writing.
By the time it was cancelled, one of my employees had spent over £800 on it.
Never did get it back.
If you do S.A.R - (Subject access request) them, you might have a major problem getting your statements, that far back.
I threatened court and they have so far sent me over 1,000 pages described as a " Full Data Protection Act Disclosure ", the point is, they said they do not keep records beyond 6 years.
I do not believe them of course, but you might meet this obstacle.
IF, and its a big IF, you can prove charges, you will allmost certainly still be liable for phone contract/bill payments.
Personally, i would set up a standing order (not direct debit) to pay them £ 4.33p PCM (£1 a week) and leave it well alone.
That way they should leave you well alone as payments are being made as per agreement.
Also have a look at this. I suggest letter N which officially puts a debt into dispute and no further action can be taken untill resolved.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.
Barclays 1 Claimed £1,260. Won by default. Paid in full

we did make all the phone payments, that was the problem we did not have a choice. And yes we did write to Bc on many occasions asking them to stop the payments. We did manage to cancel the phone in the end. to do it we had to take up an agreement with some one else then get the number moved to the new phone, silly but it was the only way.
Barclaycard have not bothered me for payments since 2004 and they have not defaulted the account. But what you have done is raised the point about 6 yrs so yes I may not get the statements so your right it may not be worth bothering. Have you read my thread Pen-V-Lloyds the latter posts are regarding pre 6 yrs and my struggle to get my statements and other info hence the disposal hearing also another good thread on pre 6 yrs is the one called claiming beyond 6 yrs by bankfodder well worth reading if you have time. I am at a bit of a lose end since i have manage to pay all my outstanding bills with my chargers win so know I am trying to rope some back.
tony I noticed from your sig that you are claiming mortgage charges back that's what I am now trying to do with Abbey, a huge chuck seems to be Lit fee's would you now if these are reclaimable.
By the looks of things Barclays have had a feild day with you. Good luck on all your claims with them. I hope you manage to get most of them back

Your case is way above me because of your circumstances.
From what i have read Abbey have caused lit fees unduly, so yes i think you can claim most back.
I am certain you claim VAT back at the very least.
Only just started on mortgages, but am learning all the time..
