I've claimed some charges dating back to 1999 from RBOS they supplied the statements (after a fight!) and I submitted my claim. They sent a letter saying 6 weeks to look into my claim. I thought ok save the hassle with the court etc....
Now received a letter back saying they ain't paying out as I am outwith the 6 yrs limitation. I've read through the other threads about this today and now just looking for some advice on how to proceed.
Since it's the bank that have raised the issue of limitations do I have to state evidence in the court papers regarding this matter or wait until the bank bring this to the attention of the sheriff?

Thanks Scott, I've read over this stuff and loads of other relevant threads but some people are saying when putting the court papers together do not mention the statute of limitations until the banks bring this up and then it can all get rather complicated from what I've read so far.
