am sorting out my appeal against the stay that has been ordered. My directions hearing was supposed to be on the 14th in cardiff.
I am looking for some advice (surprise surprise)
The bank wrote to me recently telling me thay had closed the account as it was overdrawn by £90 and they had passed the debt on to a collection agency. I have now received a letter from the DCA and the debt is now £147 with costs etc. Should I include in my objection that A&L are asking for a stay etc but still chasing money from me that was owed purely due to the unlawful charges in my oipinion if i could prove my case otherwise the debt is gonna keep increasing etc etc. also that the charges they were taking from were payments of working and child tax credits etc etc. is this a good objection to the stay. It seems to me that they can continue chasing me for money but i have to wait possibly years to recover mine.
I was gonna include a copy of the letter from the DCA as part of the objection
Also does anyone have an email for wragges. I was thing of writing the objection emailing it em as well as sending it officially to the court and wragges. the idea that if they think i have a good case they may settle (forlorn hope i know) but hey ho you gotta buy a ticket if u wanna win the lottery.
If your account is in dispute you should not be getting harassed, unfortunately the DCA may incorrectly, still ask you for payments. Contact the DCA with you details and the reason why the account is overdrawn (wholey as a result of unlawful bank charge debits), copy the letter and send it rec Del. Then put the letter in a file, you will probably have more correspondance than you would care for on this matter, eventually.
Have a look at this link re harassment, the DCA may not have the full details of your circumstances and the claim you have against the A&L. Once you have written to them they will know the facts.
