Crapital One Try "refunding The Difference Tactic"
This outfit have sent my wife a letter offering £134 as "goodwill payment" out of a claimed £198,because it's the difference between their fees and,Quote-"the £12 recommended by the OFT"!!
Accepting partial payment and amending the crappy little acceptance letter to say that we are going after the rest.And the cheeky sods also asked for £30 as a payment had not been made on the account since May!!
£198 will clear the complete balance,so they can FOXTROT OSCAR-thanks very much!!
Have now reached the end of the letter writing line with Crap One-they have now offered the same amount twice in partial payment,despite the first offer being refused.
Robert Udy sent the Mrs a letter this morning digging his heels in with this being his "final" offer
Had great pleasure in writng back to him for a final time,informing him that court action for £303 has just been lodged,and that he can stick his £134 where there is a lack of natural daylight.....
i dont understand their inconsistency, they paid my charges back after lba £120!

we have intitated small claims action against Capital One-but still the frozen brains at capital one keep ringing asking for money.
The account outstanding is £238 on a £200 limit,and they are being sued for £303.The Mrs got fed up telling them that they owe us more than we owe them and that it's now going to court,so when we got a call on the mobile last evening from capital one(private number,the sneaky gits),she was ready for them.I had primed her with advice from the membership here.....

Letter from Angelina Wilson in the executive office just arrived-no acceptance of liability of course.They are giving us this money out of the goodness of their hearts,in a spirit of goodwill.
They say that they have acted in accordance with their T&C's and it is clear that we have no claim against them.Then why don't they have the balls to stand up in court and defend themselves?Well,we all know the answer to that one.....

yes Ally,I'm from NI with Northern next in my sights, big style.
They are in breach of the DPA,and I've had to estimate charges on top of the £2K I know they owe me,of another £2.5K roughly.If they cough up the first £2K(as we know they will),I'll be looking for the whole lot,or I'll take them to court for the DPA breach as well!!
I've learnt the hard way not to take any prisoners in this game.Just lay it out straight and they are left in no doubt where you're coming from.

Tell me something - when you were doing your Capital One claim, did you lodge your court papers with NI small claims as they have told me it could delay things as the papers have to be served outside their jurisdiction?

Anyway-don't worry about the NI claim affecting things too badly.There will be a bit of a delay,but when the Claims Office In Chichester Street "query" your claim(as they have to do as it's being served across the water),they will send you out a form to sign and date.It is just to give assurance that you are not pursuing a similar action against the same bank on the mainland.Just sign and date and return with a simple covering letter detailing the claim details and court number you will be allocated when you start your online claim.(It will begin 06/xxxxxxxx.)
Now,to speed things up a LOT(and Miss Magee in the Claims Office is totally ok with this-I've spoken to her on the phone,and she is really helpful) ,simply photocopy the form they send out (before you sign it of course) several times for how many claims you think you will have.Then when you start a new action,post off the form signed with a covering letter the same day you lodge the online claim,and the whole thing gets activated right away,ready for papers serving.It does cut a few days off the process.

whilst you must always begin with the intention of going all the way to court, i think that you will find that these bankers do not want to go all the way
Capital One agreed to my demands fully,so once we get the cheque,and confirm via the automated service that the balance is clear,the court action will be stopped.
