after some family probs and death of a dear relative ive finally got to the stage of doing my n1 claim forms only to have a letter from a&l arrive this morning saying they will put an aplication of stay on my claim until this teat case is done can they do it and should i put it in still they owe me £2558 alot when u consider it was my benifit money
Yes, Do it!! They are just making things difficult for everyone. Ignore all their threats and go ahead to claim what it rightfully yours. Its well worth getting it going now rather than at the end of the year.

thing is when they were charging me and to this day i was on benifit income support and dla i was left with next to nothing with 5 kids to look after can i push for my case to be looked at now as its caused me finacial hardship
Hi Emma, sorry to hear your bairns have been going without because of bank charges, carry on with your claim and attempt to get the stay removed.
The grounds on which you can base your request for removal are stronger when your benefits are taken and hardship results (I think). I remember reading a thread on a similar vein, but I cant find it just now.
Check out this link in the library if you have not seen it all ready.
If you have already started court action then on the thread mentioned in previous post you have to fil in form N244 and pay £35.00 ( not sure if you are not exempt.
If you have not started court action - i suppose you carry on and then send the letter to the bank.
Which court will it be - we might be able to check out what is happening with other cases there.

Also go to search button above - do advanced search
enter STAY
and look for threads ( not posts) you will see lots of threads asking questions about having stays lifted

Hi Emma
If you have a case of genuine financial hardship, A&L must deal with your conplaint under the Banking Code if your not happy with the banks responce to your complaint, you can take it to the Ombudsman, who will consider wether your complaint can be dealt with BEFORE the test case is resolved. Hope this helps
