Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
The Oxford CC have thrown out the A & L defence and awarded me the judgement!! A & L failed to submit their skeleton defence in time.
Wragge & Co have today tried to settle for a lower amount after being given 3 opportunities to do so earlier! Why would I want to settle now when I have won!
I will now resubmit a full claim including all the updated interest charges, court fees etc and also try to get some money back for the time I have spent dealing with this. I understand that the judge may award this to me but they don't have to.
Has anyone else managed to get anything back for personal time?
Well done I've never heard of A&L/Wragge actually submitting their court documents at all, so the vast majority seem to be winning by default if they hang on, or taking a lesser amount if they need the money in a hurry.
Having just won judgment by default, I'm in the process of attempting to claim for Wasted Costs. See this link (if you haven't already) :-
I'm claiming for £500, which is a lot ... I haven't read of anyone being awarded over £300 yet, but I do have just about all my receipts and Recorded Delivery slips, so worth a try. There are no guarantees you'll get anything of course and the judges will often cut down your preparation time drastically.
If it would help, I could email you my schedule detailing exactly what I've claimed for and the costs involved. If you'd like it, PM me your email address.
