took out a £5000 loan with Barclays. no problem getting it what so ever. was over 5yrs at £222.57 a month. cant remember the apr. but what i do remember is i was told i had to take the PPI or i wasnt getting the loan. was quite simple really take it get the money, dont well goodbye.
now i think i managed to pay for about 18months before i lost my business and things fell apart around me. i couldnt use the PPI as i was self-employed. im not sure how the ppi was sold to me, wether it was added to the loan overall or what.
i have sent SAR to barclays requesting all info they retain on me. was sent 10 of july, they got the letter and signed for it on the 12th. no cheque been cashed yet though.
even though it is over 6yrs can i still claim it back. as i think the last payment on the loan was august of 2001 so should still have a record of it. nearly the full amount of the second loan was to pay off the first. im sure they would have payed the PPI up to.

I have been successful in two cases of mis-sold ppi on loans that were taken out in 2001 without having to go to court.
If they argue the limitations act, you argue that I has just been brought to your attention with recent statements and coverage from the FSA and OFT investigating the ppi market. Also mention their concealment. I have letters that you can look at when the time comes to reclaime it.
Wait now for your SAR and if they start dragging their heels, chase it up

have just got statements. not all of them once again. no statements for the first loan.
the second loan was for £3000 they added a insurance premium of £338.86, now im not sure what percentage of the £118.25 was to be payed back on the insurance premium. i know the loan was to be paid back over 5yrs. after 17 payments i was out of work again. buried my head in the sand once again.
now after a year of arguing with Barclays. i asked was a PPI added to the loan, they told me yes. so asked how i could claim was given info.
contacted the ppi. which was barclays in Shannon. all paperwork was sent. but they only ever said they would pay for a years worth of the loan. which was all i got. i still owe some on the loan which they are chasing me for.
now seeing as they paid a years worth of payments and the intrest. can i still take them to task. on the second loan which was a resolve loan. so had quite a higher intrest rate.
the first loan was for £5000. which also had PPI with it. no idea what premium they added to the over all loan. as cant find any paperwork. i have the account number i have proof of payments. i also know how much of the resolve loan payed off the this loan.
can i do anything to claim any of it back. because if i had payed this higher than high amounts for insurance, i wouldnt have been getting into so much trouble with finance
Have finally got my statements for the first loan.
also inclosed was a nice letter telling me to F*** off in a nice way. they dont force people to take out PPI on loans. funny that, im not the only one with the same complaint.
my mistake also the first loan was for £4000 with a nice lump sum of £516.01 of PPI added the same day.
just spotted that when the loan was closed they made a payment of £94.59 insurance refund. so after 14months of having paid £516.01+ interest on that for the 14 months i get a small token payment back. something not right surely. as i did try and claim on it i was told being self employed i couldnt claim.
so was sold a resolve loan over the phone. i wasnt advised to seek outside help with regards the matter was just told this was my last option or be taken to court. knowing what i know now i would have gone to court. i would have got a better deal instead of being in debt with loans.
so my next step what do i do. do i carry on a fight them, hell yes.
they didn't explain my options to me properly. they have instructed outside DCA's to hound me for this money they say is still owed against the last loan.
so they owe me im going to collect just need a bit of help please. what is my next step. they are menat to be ringing me back today to speak with me about it. i don't expect them for one minute to agree that it was mis-sold. they will go with the you could have cancelled the protection you had 30days. yer and wouldn't have had the loan any longer. catch 22 never ending circle all spring to mind.

Me thinks they are protesting to much. Be careful if they ring to today record the conversation if possible, agree to nothing, unless it a full refund. They will try to bluff you, tell you anything and them retract from it. them to put it in writing so you can think about it.
Do you have the credit agreement for this loan, the ppi policy and the terms and conditions of the ppi.
Did they send you a default notice?????

My My they don't surprise me al all. Did they mention court or was it you?? Where they trying to intimidate you. Don't be put off, that is what they are hoping. Its like a big game to them. They are like pathetic little bullies who have a tantrum when they get found out.
They won't give you a straight answer, because they would have to admit they have robbed many a customer who trusted them in the name of unjust enrichment.
As for the stupid comment regarding the 6yrs limitation of claims. It is 6yrs from the time that you find out. They truely need to get their facts right.
I am so glad that you are not put off. Start the process and get your money back Oh and donlt forget to claim for contractual interest as well.
