Claiming payment protection plan Barclay card. Do I qualify?
Only recently, since I went out volunteering and had no more income, did I start paying more attention to my Barclays card statements. There I was wondering what this payment protection plan was.
I can't remember ever asking for such a plan and Barclay card is telling me that they have no signed agreement between me and them confirming me taking this plan.
They inform me that this plan can be sold over the phone and I do have a policy regarding this payment protection plan, but no proof of ever agreeing to it. But I should have know about at least having a 'thing' called payment protection plan.
However, since May 2006 I have left the UK and informed Barclay Card of my address change. According to the payment protection plan terms & conditions I am no longer eligible to have this plan.
Still it was not cancelled. As barclays card recently informed me that it is not their responsibility to either cancel this policy or make sure that the 3rd party that is the actual issuer of this plan gets my change in address.
So I am wondering if I do have a claim or that I should have informed this 3rd party of my change of address? Should I have cancelled this plan the moment I saw the policy? Very confusing.
Most remarkable is this sentence in their reply: "Customer service advisors are not permitted to provide guidance or information regarding insurance or related products in accordance with the FSA guidelines, and therefore would not have been able to advise you to cancel the policy".
This sentence made me wonder who than sold me the PPI in the first place? Certainly not barclays card staff? Because that is against their regulations. So, did they have the right to give my personal details to a 3rd party to sell me this PPI? Or did they breach the data protection act?
Anyway, I am far from a laywer and it isn't a lot of money, but it is the principal that counts. 8)
If I haven't confused everyone too much, I hope that at least someone could tell me how to best handle this and what the chances on reclaiming what are.:-?
