    Default How YOU can play a part in the OFT test case....

    Send us your T&C's!!!

    We're in need of Halifaxicon current account and general banking T&C's.

    Every user must have at least one set of Terms & Conditions stashed away somewhere! Please search them out and scan them to us at the following e-mail address (preferably pdf format) -

    evidence@consumeractiongr oup.co.uk

    Any relevant terms and conditionsicon will be put forward as evidence against the banks in the OFT test case. The OFT have indicated that the case will be conducted on the basis of a "representitive selection" of the banking contracts past and present.

    We want to ensure the selection is as varied as possible and that the banks don't get to cherry pick only the contracts which happen to suit them.

    If you do not have a scanner or cannot guarantee a good quality scan, please post the original documents to the following address. Preferably take a copy before you send them - although we can return them to you if you indicate you need them back.

    Does this now mean that CAGicon has a direct means of contributing input to the case?

    If so, would that extend to collating other information such as banks misinforming claimants, not forwarding banking history within timescales, taking up court time, treating customers differently, etc, etc.

    Any advice given by me is based solely on my experience in claiming, my experience in CAG or my opinion. I have no legal background. I want to encourage others to reclaim what is theirs.

    Got a DCA breaking OFT guidance. Complain to the OFT about the DCA. Help put an end to these practices-

    We hope to have, yes - in conjunction with a couple of the other large consumer groups.

    Not really, unfortunately. This case is only concerned with how the law applies to the banks overdrafticon charges.

    Gary, will there be anythying in the case with regards to Banks applying charges to income related benefits? This is a growing concern. I am happy to help with this side of the law if needs be, but feel it should be included. Yes its a case about the actual cost to the bank, and this is a different law but surely we need to have it included? (have I just answered my own question?)

    All advice is based on my experiences. I am NOT qualified and as such cannot be held responsible for any mistakes. If in doubt...get professional help.

    Halifax Bank - Owed £1599
    23/3 - Data Protection Act sent
    24/5 - Data Protection Act finally arrived
    25/5 - Demand for repayment sent
    04/10 Court bundle filed with court and Halifax
    29/10 STAY ISSUED
    JAN 08 - Currently being harrased by debt collectors!
    Mar 08 - New DCA - Stopped in there tracks
    Jun 08 - And another
    Jul 08 - Complaint made to HBOS
    Nov 08 - My accounts been sold to a DCA
    Jan 09 - New complaint issued against HBOS
    Mar 09 - Halifax re-aquired the debt
    Apr 09 - Applying for Hardship.

    at least they removed 2 defaults in selling accounts!


    I dont not claim to know everything and any advice i give should be treated as MY opinion.
