    Default Claiming back fees on behalf of the deceased

    I lost my brother a couple of years ago, and he left fairly big credit card debts that had to be paid. As administartor of his estate, I wondered if it was possible to claim back fees on behalf of the deceased? He had an Abbeyicon credit card and most months he had penalties. Thanks for any help.

    I don't see why not. They were unlawful charges and even though your brother has died, the money belongs to his estate and as executor you have a duty to distribute it according to his will.

    The bank won't like it though and will put every obstacle in your way. Do you still have his statements? Otherwise finding out the exact amount could be a problem, they may say they no longer have his records etc and you will have to send them proof that you are the executor before they will deal with you.

    But if you think it's a reasonable amount of money it's worth having a go

    Yes, they know I am the executor as I had to prove this two years ago, and I do have all the statements, so adding up the sums should not be a problem.

    Beware that they will probably make a booboo and write to your brother so warn anyone that might be upset to see letters turning up addressed to him.

    Abbey (Charges on 3 accounts and default on my credit record) - DPA letter sent 30/03/06 - 40 days limit is 9th May - Recieved DPA printouts 05/04/06 with microfiche "fob off" letter. <p>Barclaycard (Charges on 1 account and default on my credit record) - DPA letter sent 03/04/06 - 40 days limit is 13th May - Recieved some statements 08/04/06 along with DPA printout and a microfiche "fob off" letter. Claim for £340 sent 11/04/06

    Initial letter sent on 15th June, and today came a very nice letter and a cheque for the full amont requested (£351.06 - inc 8% interesticon which I may have jumped the gun requesting?).

    Thought it might have be difficult claiming for the deceased, but hopefully this will have opened the door for others as well.
