Could someone please tell me how long does a DCA have to respond to a CCA letter - I have a proof of delivery for the CCA letter dated 2 July 2007 so how long do the DCA have to respond? I thought it was 12 days then someone said 30 days so now im confused. can someone please clarify it for me. And also what is the next step when they dont respond? and what letter do I send and to who?

Hi
When you send the request if they have not responded by 12+2 days the account goes into default and you can stop payment.
If they still havenot responded after a further 30 days they are commiting a criminal offence.

After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.
If a FURTHER month passes then the DCA has commited a summary criminal offence and the matter should be refered to Trading Standards for action.
I hope this clarifies some things.
Now there is no point is reminding about the time limits as they are aware of them.
They normally ignore them, but that's their problem.
Now the best course of action is to wait until the are passed BOTH deadlines, and they start demanding money, before further action is taken.
Now further action entails a report to Trading standards in the first place.
Obviously if they DO comply and the agreement is valid then payment MUS be made.

The agreement can be any age. The fact is was made over 6 years ago DOES NOT make it barred.
A debt becomes statute barred when no acknowledgement, in writing or payment, is made in over six years.

there has ben no acknowledgement of any debt or any payment within the last six years regarding this alledged debt does this mean it is statute barred and they have not replied to my request for CCA since they received the cca letter on 2 July 07 so do I have to wait 30 days from 2 July? Just to clarify the matter do I now wait until they contact me again or do I now make a formal complaint to financial Ombudsman and fair trading?
