Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hello everyone,
I am new to the forum and any help and advice i receive will be hugely appreciated.
I believe i am a classic case of mis-sold loan protection by Lloyds TSB. My account manager at the time advised me that purchasing loan protection will not only improve my chances of getting the loan, but also of getting the load at a lower interest rate. Silly me, i believed her. Now i know that what she told me was totally untrue, and i also doubt that i qualify for the loan being self-employed and etc.
It goes without saying that i am very unhappy with my loan protection and that i want my money back. But before i start reclaiming my premiums , i should get my terms and conditions to read about exclusions and so on.
The interesting thing is that at the time of purchasing the loan protection, my account manager didn't give me the full terms and conditions because she couldn't find the loan protection policy wallet( the booklet with the full terms and conditions). So, basically i don't know what i signed for.
I am going to write a Subject access request to aks for the full terms and conditions, but i am not sure what to request exactly. Any advice on that?
The thing is that i do a lot of banking with Lloyds, and if i send a full S.A.R asking for every single peace of information that they ever had on me, I am sure they will send me a truckload full of documents.
Since i am going to complain only about my loan and the loan protection, is it possible to ask only for all the information the bank holds pertaining specifically to this loan and to this loan protection policy???????
And if i do so, shall i pay the full £10?
Can i also ask the bank to send me a break down of my loan charges such as premiums, interest on premiums and etc?
Can anyone think of anything else that i should ask in my S. A. R?????

Hello and Welcome
Regarding your SAR You will be surprised how liitle information that they will actually give you. They only give you what they want you to know. I would recommend that you ask for everything, even thought it may be a truckload, all information is required and a lot of homework on you part will be needed.
The SAR is a legal requirement under the DPA and when you send the £10 fee that is required, they enter into a statuatory duty to provide all information they hold on you. The have 40days to comply with your request and if they don't they break the law.
If you just ask for certain information without a sar, they can ignore you and you will not get anything or if they do respond it may be in the year blah.
I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts
Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans, payment protection insurance and other products. - Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

Thanks a lot,hellhasnofury,
I would never have written such a detailed request on my own. I sent it today by recorded delivery( signed and dated cheque enclosed), and all that's left now is to wait for their response. I hope they will not leave it till the 40th day to reply; i am so impatient to get the whole thing done and over with.
I will keep you guys posted on any developments.
In the meantime, i will start working on my letter of complaint.

Finally Lloyds replied to my S. A. R and they are acting very weird !!!!!
I received a number of documents including a copy of my loan agreement, a list of all monthly repayments that I have made by direct debit, and a few sheets of paper containing the personal information they hold about me ( eg, date of birth, nationality, address, e-mail , telephone number etc.).
It is all exactly as I anticipated except for :
1. I specifically asked in my S.A.R for the full terms and conditions of my loan protection policy, and Lloyds didn’t send it at all.
2. In the S.A.R I wrote : “ I enclose a cheque for the statutory maximum fee of £10”, and Lloyds send me a letter saying and I quote : “ Thank you for making your payment of £10 . We have credited it to your loan account.”
How weird is that !!! Why would they credit it to my loan account? I thought Lloyds would keep the money to cover their expenses.
What shall I do next?
I sent my S.A.R to Lloyds TSB customer service team at 25 Gresham Street. Obviously those idiots from customer service are useless. Shall I pursue the matter, and ask them to locate and send me the full terms and conditions of the loan protection policy? Or shall I write to Lloyds Insurance directly and request it from them?
I just want to have it on record that they haven’t complied with the law and haven’t sent me all the info I requested.
