Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I received a parking fine for parking in a bay for 15 minutes longer than i was allowed but it says on the ticket that my car is blue - it is black..... can i get away with not paying it??? Help......
No not really you can try but its not grounds for cancelling pcn. Black and dark blue are similar as are grey and silver, some blues and greens etc etc PCNs would be cancelled all over the place if the Warden had to guess the correct shade to make the PCN stick.
BerryN .. you could try looking at other posts on this forum .. it is full of people who seem to take joy in wriggling out of correctly issued charges - they will give you losts of advice (sometimes questionable).
It seems that you DID out stay your allocated time and got a ticket .. I am sure the signs on display clearly stated what would happen if you outstayed your time .. you did and got exactly what it said on the tin !!
You had the choice when parked to pay for an extra xx mins, you decided not to and therefore got the ticket .. Some would say "Fair Cop" .. others as I am sure we will see in the next few posts will quote all types of reasons for you trying to avoid paying.
Thats ALL i will be saying on the matter (before people start quoting and asking me questions .. so dont waste your time) ...
Different rules apply depending on whether the ticket was issued by a Local Authority Warden or a private company.
If a private company issued, you can challenge the ticket using UTCCR 1999 1(e). The company is expected to charge for its actual cost of your default. You got into a contract with the company for using the car park area operated by the company. The company is not expected to profit from your default - the law forbids that.
