Can anyone give me advice, i am at the point where i have filed through MCOL and have been informed that my claim has been forwarded to my local court, however i have not recieved a allocation questionnaire. Phoned the court and told this would not be sent and to await Judges "direction". Few weeks later [problem] sent a letter offering to enter into settlement, without liability of course, but required further information which had already been sent to ltsb. Sent this again 2 weeks ago have not heard from [problem] or my local court, last correspondence from court was on 19th June. Now with Fridays announcement i am totally confused, what would be my next move, phone courts, phone [problem], wait or have i now missed the boat. Any advice would be appreciated.
Hi, I would phone SC&M and remind them they have offered to settle, see what they say. And just call your court and ask them if anything has been sent in or are you expecting anything.
Don't stop the court case until SC&M have paid you, and check your bank account if it's still open, they may have paid you already!
Don't worry about the allocation questionnaire, they are mainly dispensed with, so you would just get a further letter from your court soon. It did take a few weeks for me to get mine, just call them and check.
I don't see how SC&M can go back on that offer, and it's something else to put into court if you have to.
SC&M did not honour offer in end and said assume my client intends to go to court therefore i made the next move and placed claim with local court. Lloyds have now defaulted and did not place a defence in on time and i then requested judgement which i now have.
The frustrating part now is that no one will give me an answer on this have tried Brighton, Andover offices have even been into my local branch, they could not help me either. I have been passed around the houses and came back to where i first left off. Today i faxed a copy with a cover letter to the Andover office requesting they deal with this immediatly. I have tried to call them but keep getting put through to a automated machine saying we will get back to you in 10days.
I really thought this was the end of the saga, but now read they could apply for a stay on a judgement of default, how much more time are they going to get? i have been fighting this for over a year now and am coming to my wits end. They certainly know how to turn the customer service around and close the doors when they owe you.
Any advice on my next steps would be appreciated, i have ran out of answers and as the claim is now above 5k with interest i will need to claim for and execution through the high court, how much is that going to be?
To compound my situation Lloyds are still applying charges and interest to my charges and interest already incurred. I refuse to pay as they owe me but i am getting calls and letters saying i am ignoring there letters and SC&M called requesting i pay the sum outstanding on my account, and when challenged with the judgement admitted no liability and pointed me back to Lloyds. So frustrating
