Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I opened up an account with the A&L at the end of last year as a safe guard, pending the possible closure of my account with N&PBS as I was thinking of reclaiming the charges!
I put £10 in as an "opener" and thought nothing of it until the A&L phoned me at work asking if I would like their Data Protection Insurance. Just to get rid of them I said yes, the operative said it would cost £? - can't remember!
Anyhow, kept getting letters and statements from them, and really couldn't be bothered to even open the envelopes, as I had forgotten about the insurance thing. Yesterday, lo and behold, got a letter from them:-
Dear Windywoo
The amount outstanding on your account is £253.13.!!!
This matter is being put into the hands of our Debt Recovery Section to begin proceedings for the recovery of the amount quoted, unless the overdrawing is cleared within SEVEN days from the date of this letter (25th July)
The proceedings could result in county court Judgement being made against you blah blah blah!!!

I am absolutely furious they have helped themselves to this money from an account that had a tenner in it and expect me to pay it back!!!
NO CHANCE!!!! Sent SAR in post yesterday, they won't get away with it!!
If its a sales call and you only ever agreed to it over the fone maybe you could get them with not having your signature on a credit agreement, not sure if there is any other loopholes but check out some of the sections on here maybe you can find more help http://www.consumeractiongroup.co.uk.../general-debt/

Dont know how you stand hunny, its a charge you agreed to. Have they put penalty charges on that too??
Jenny
Its all penalty charges!
I didn't sign anything, and the insurance, I believe, was a one off payment. Obviously the account didn't have overdraft facilites, and this is where they have got these figures from! Penalty charges, overdraft interest and the charge for the non payment of the insurance!

Hiya WW, Its a charge for a service, which you agreed to but if they have misled you, you can go for it. Barclays had the same thing with overdraft protection i think...if anyone knows more on this one, i think it was on whistleblower???
Because they called you and you agreed to it, its a verbal agreement, but if they have taken charges you didnt agree to they have mis-sold it to you, contact their customer services.

From what I remember the one off payment was about £50 ish, obviously as the account only had £10 in it with no overdraft facilites, they did not honour the one off payment for the insurance, and then added the penalty charges for being overdrawn on an account, which was created by the penalty charge for the non payment of the insurance!!
This was the only "transaction" on the account, I hadn't used it for anything else!
If you can put the account into dispute you can stop them adding more charges, if they only have a phone call from them agreeing to it, then you can even dispute ever agreeing to it. Hence your account would have to go back to the original state with just your £10 in it.

Hi, Complain to the OFT, A&L have already been fined for "retaliatory account closure" It'll take a while beleive me, the same happened with me and Barclays in december and the oft are still dealing with it...on the good side, i am looking to be awarded compensation for this. Have you got another account? If you have good...just carry on...if not ring a&l and tell them what you are going to do, that you feel they have retaliated by closing your acc because of the claim in progress,
