We had to rush our 2yr old Son to A&E yesterday evening for severe breathing difficulties. We arrived around 7pm and parked (without incident) in one of the 'free' spaces outside the doors. After he was transfered to a kids ward I left them at around 3am to return home for some provisions. I returned around 3.40am and had to park in the EMPTY maternity (Pay and Display) car park.. as I had no money other than notes (and with nowhere to break them) and more pressing matters on my mind I simply locked up and went.
After a sleepless night I went out to get some nappies only to find a lovely yellow sticker with a '£40 Charge Notice' paper inside it.
I voiced my objection to the mini-Hitler type loner but it fell on deaf ears. He simply gave me a number to call to appeal.
The fine is 'only' £15 if paid within 14 days but as we frequently PAY to use the Maternity car park (my partner is expecting) I hate the thought of giving this Gestapo-like bunch anymore for a one-off 'violation'.
We tried the phone number but was told to write to them... I don't like the idea of this as (despite them being able to get our address from the DVLA) it gives them our name / address etc.
What would be the best course of action? Simply wait? Are there any loop-holes? The car is in my partner's name but I was the one who parked it 'illegally'.
I feel as though our reasons will be ignored and we would simply have given them our details for free should we write a letter.
The P&D signs are not lit-up at night if that counts for anything?
I hate to sound like a penny-pincher but this really gets my back up.
I know its ages ago but was the result ? We are in a similar situation - 10 year old injured etc - had to be helped to carry him - no money on me etc

we have already had a solicitors letter threatening immediate legal action - this arrived over a week before a response from the parking company ( great system they have) - of course all letters do not mention or address any of our issues but are merely standard replies Worryingly the time they quote for the ticket meant that they would have seem me struggling to carry my son ( and a passerby helping me all the way into A & E) and would have seen them for themselves my situation.

How diabolical that this should be allowed to continue. CP Plus is making a fortune living off the suffering of sick and needy people at Whips Cross Hospital. NOBODY goes to hospital for fun, It’s not exactly a night out at a club or casino.
So many heart rendering stories of people in need of help, getting a sick family member to hospital, or visiting sick friends and relatives.

Reading through CP Plus’s web site is a joke. It’s such an obvious attempt to gloss over their primary objective...... Making Money!
CP Plus you should be ashamed of yourselves, you are worse than the worst of worst ghouls.
The system is also self defeating as out patients would rather call for an ambulance instead of taking their own car and running the parking hurdle and thereby burdening the already overworked ambulance system.
There are so many care and loving organizations doing what they can to help the sick and the needy and yet this company is allowed, no encouraged, to add to the misery.
Time for a revolution.

Be careful what you wish for.
If private parking penalties were specifically outlawed, or everybody refused to pay so that the [problem] ceased to be lucrative, they would move onto something else - like clamping.
I've just read an article about how fanatics rule the world due to the complaisance of the rest. Quoting how the Nazis took over Germany. It's also true of this situation.
If everybody just sits back and lets it happen then these legal thieves will be allowed to get stronger and stronger until they have complete control.

i knw this is a very old thread but i'll make things pretty clear.
i work for these so called clowns CP plus, at a morrisons car park.
morrisons DO pay cp plus an annual fee to have the car-park patrolled.
i wear a hi-visable car-park attendant coat so im clearly seen on the car park & patrol the car-park in putting car registration number plates into a hand held computer device.
the device informs me if a car has over stayed by the MAXIMUM 2hours free stay time allocated for the car park, which then u get an extra 15minutes on top of that, so technically you get 2hours 15minutes free parking).
i dont understand how you have recieved a ticket if you was only in the store for 10minutes, it should say on the ticket the time the attendant 1st seen your car and the time the ticket was issued.
my only guess could be that you previously came to the store earlier in the day and returned to the store with-in 3 hours meaning the attendant thinks your viercle has overstayed in the car-park.
The customers that shop in the morrisons where i work are regular and if they do intend to come more than once with-in 3 hours they will inform myself to avoild being issued with a ticket.
my advice is, if you think or know that you have recieved a ticket unfairly then by all means fight it tooth and nail, but i can assure you that many people think CP plus is a small company and dont pursue a £15/£40 fine, but in actual fact they do.

i only give tickets out if customers overstay by more than 2/half hours

if customers approach me who ive issued a ticket to i'll explain the situation & why the ticket has been issued, if they have caused an obstruction, parked in a restricted area or parked over 2 pays the fine will stay, if they have overstayed but have come and seen me, 9/10 i will voild the ticket there and then myself.
CP plus car park attendants like myself, dont earn any commision or get any bonuses on the amount of tickets we issue. we are paid £5.80 per hour and thats it.

'Pursue' as in send 5 or 6 bits of junkmail? They do that for every invoice (not a fine).
I'm not being facitious, but do you know the legal ins and outs of your tickets or do you just issue them because it's the job? Do you believe the things CP Plus tell you (do they tell you anything?) or do you accept that they just send out threatening junk to keepers and collect the cheques from the unenlightened?
Anthony would you be the twit that booked my car when I returned to the same Morrisons store after my niece had taken my wife shopping only to find that she had forgotten something and I went back to get it. Two different drivers so as to my understanding of contract law two different contracts, I did not bother to respond to the sad letters I received from CP Prate as they were not worth the paper they were written on.
When you can explain how the return of a vehicle can be an offence when you do not have a record of the driver then maybe we can go further with this discussion.

c & P can not legally chase anyone for money regarding parking fines due to a change in the law. They are not a government body therefore the offenses they have charged you is a CIVIL matter not a legal matter therefore they do not have a leg to stand on regarding parking fines. The only fines which can be upheld by law are fines issued by the council / traffic wardens on highways and byways etc - private company parking fines even when they write to you can not refer you to a debt collection agency or prosecute you as unless they can legally prove WHO was driving the car ( which you do not have to disclose by law) they can not chase the owner for money. It is a civil case against the driver and if they can not prove who was driving then they do not have a case and even if they did have a case you haven't broken any laws.
So even if they do threaten you via latter it is an empty threat- shred them
Sorry I work for the NHS and even cancer patients get fines and they get so stressed about them. I cant speak publicly about these fines so posted it here in the hope that at least someone will get some benefit. I know others probably say the same but hey one more voice to add the the population wont do any harm eh?

Please get your facts right! These are not FINES, they are unenforceable invoices. To use the "f" word when describing these charges gives them the legitimacy they don't deserve.
I've just read the parking policy for the hospital I work with and it states that a "Penalty Charge Notice" will be issued for infringments of the parking policy of £40 or £15 if paid within 14 days.

for goodness sakes if you read m previous post i was agreeing with what you wrote- my patients get the penalty notices on their cars which they think are legal "fines" which they aren't - i hate this system. These people have enough on their plates. People are so aggressive and don't read previous posts I used the wrong word but my intentions are the same - I care about my patients and hate what c & p do
