Hi, followed the site for a while but this is my first posting.
The story so far.... have taken A&L to court via MCOL (issued 9th July 2007 and served 14th July 2007) for £900 + costs + interest. Wragges have replied with their standard defence letter.
In the meantime I received a letter from A&L offering £564. I rang them to say I would not be accepting their offer and would they increase their offer on 17th July and their reply was a letter had been sent out to me increasing their offer to full settlement of £1014.12. Having not received the letter and 2 phone calls later, reiterating their offer i receive exactly the same letter 5 days later offering the same £564.
I have now received 3 letters in total offering £564 dated 13th July, 16th July and 25th July!! Every time i call they say a letter has been sent out offering the full amount!
Are they stalling for time due to the OFT test case?? Should I accept this offer of £564 as i think i will have problems proving their verbal offer? Or do you think I should hold out for the full amount. Will this case be susepnded or because A & L are not involved in the test case are they not applicable??
Firstly all communication betwenn you and the defendant must be done on paper. phone calls just add to confusion, and anything said, can be taken with a pinch of salt. Go on the Forum and pick a rejection letter to suit or change one yourself to suit your particular needs and send it to them A.S.A.P.

I called A&L today and they suggested I return the letter, cross out the amount offered and write in the amount i was claiming and would settle for, return it signed and they would act on it.
Should i do this or send a rejection letter from here?

I,dear lady filled two bags with shredded paper the other week. It seems just when you have everything, something else pops up. The banks should be fined on the costs of wasted paper, ink and time as well as paying what they owe us.

Hi, just an update on my case and a bit of advice please if anyone can help. I filed through MCOL and Wragges have acknowledged. They now have until Saturday (maybe even Monday due to weekend) to defend the claim.
Do you think they will submit a defence? I have not heard anything about them applying for a stay, but daren't tempt fate by ringing the court to find out! lol
If they do not submit a defence would i win by default?
Any comments gratefully appreciated (to steady the nerves!!!)
Foxy here, 'Nerves' who needs em? You've done your bit, now sit back and relax. As for whether you'll get a defence from Wragge's remains to be seen. 'Don't go chasing rainbows', no matter how tempting it is to phone everybody, my advice is DON'T just Wait.

Not heard anything from Wragges apart from to say they would defend the claim 3 weeks ago!
Forget the Martini - it will be champagne all the way if i win!!! lol

Hi Jansus, just looked on MCOL and they have submitted a defence! Just my luck lol, looks like I am going to have to wait and fight it out with them!! Will have to plead "financial hardship" if they want a stay.
