    Default Payment problem

    My son has an arrangement (made using CAB) to pay a credit card debt.

    He pays monthly, but a few months ago when he was unable to pay (we were getting lots of calls) I made one payment. I wasn't sure of the amount or when he could pay next, so I asked if I overpaidicon, it would be taken as his next payments. They said yes (otherwise I wouldn't have paid). When they started calling the next month, I phoned the DCAicon and they said that overpayments are taken off the balance and they still expect the next payment according to the payment schedule.

    Has anyone else had any experience of this?

    Surely DCAicon's don't tell lies to make sure they get their payment. Its no good talking to these people on the phone, you really do need to get everything confirmed in writing.

    I would just pay the next payment when it fell due and if they start phoning and threatening I would send the Telephone Harassment letter.

    LEt's look into this a little more.. Who are the DCA, do they 'own' the debt, have you sent them a CCA ?

    If the Banks maintain their charges are transparrent and fair, then why appeal against the decision which allows them to be investigated?

    First NEVER talk to these "people" on the phone as they will try and get you to agree to anythin.

    Before you even think about making any sort of acknowledgement or payment to a DCAicon you MUST ensure that they have the LEGAL right to collect the debt.
    This is achieved by requesting a copy of the Signed, Excuted Credit Agreement via a Consumer Credit Act (CCA) request.

    Is it important to start the letter:
    I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters.

    It is best to send this request via recorded/special delivery as there are some inportant deadlines to observe.

    After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.
    If a FURTHER month passes then the DCA has commited a summary criminal offence and the matter should be refered to Trading Standards for action.

    Thanks for your comments so far everyone

    Unfortunately things aren't quite that simple.

    Son is a complete idiot with money, it's actually a comfort to know that he has only a few grands debt rather thean the tems of thousands that he could run up if he was able to get more credit, and currently everything is ok with him paying a fiver a month.

    The DCAicon is Intrum Justicia

    I did phone them yesterday (I had a manager's number from when they were a bit over-enthusiastic before) about something different (them phoning the house). That's sorted, didn't mention that payment (forgot about it), but the manager did say that son was nearly a month late with the payment & they might have to terminate the arrangement & send it to court. Had a few words to say about that and said he would probably be able to pay next week.

    However that makes the over-payment business more immediate - in my eye's he's ahead but they are treating him as if he's in arears because they took the pre-payment as a donationicon to reduce the overall size of the debt.

    Any thoughts?
