    Hi

    I'm about to start proceedings against The Royal Bank of Scotlandicon!

    I'm currently calculating my total; however, i'm confused about referal charges?

    1.what are they?
    2. can I claim them back?

    any help would be greatly appreciated

    Referral charges as I understand them are where they have paid something that they would otherwise have bounced. Whilst at the time they were probably doing you a favour it does not cost them £12 or whatever so I would reclaim them as penalty charges. They might try to argue that they were providing you with a service but I have included them in my claim against Nat West.

    Yes you can claim "REFERRAL CHGs" - you can't claim your account monthly fees which are generally just referred to as CHG but most other things you can claim.

    Be aware that the monthly charge and the referral charge tend to be merged together at the end of the month. So if you get a charge for £28 + your monthly charge, whatever that may be, then you can claim the £28 not the rest. So if you are on gold (fool ) your end of month charge will be £43 (£28 + £15), you can claim the £28 not the £15.

    This was the case last time I looked, left RBSicon in December so things might have changed since then......

    Hey guys, thanks for the advice

    another question:

    My total charges amount £6143.

    I can only claim up to £5000 in a small claims court right?

    so....should i try to claim the £5000 first, then the £1143 (is this possible?) or cut my loses.

    any help - would help.

    Claim for the whole amount as one claim - and request that your claim be heard in the small claims court at the aqicon stage. Plenty of claimants have been successful with this. And it really doesn't make sense to split your claim at this stage.

    Anyone else here know what the monthly account charge is for a Gold account? (yes! I'am a fool )

    The account charge seems to be changing from month to month; for instance june - July was £25! September is £40.00!! they seem to charge what they like from month to month.

    this Month:

    Maintence charge of: £28.00

    Plus fee of: £12.00

    so I can claim back the maintence charge of £28.00 right?

    You can't reclaim the monthly account charge for the Gold account as this is a fee for a legitimate service that you signed up for. And the account charge should remain the same each month.

    However, the 'maintenance charge' (previously called unarranged borrowing) you can reclaim. But you may need to place new charges onto a seperate claim as they're not part of the claim that you have currently filed at court. The only way to include the new charges would be to file an amendmenticon at court - and this would cost £35 which you can't reclaim.

    The bank have not responded to my first letter ( Preliminary approach for repayment.) & the 14 days are up!

    I'll be sending the letter before actionicon tomorrow first thing.

    Hi

    I recieved a reply from the bank today, as i understand the bank/s have become involved in legal proceedings with the "OFT" (as stated here here.) and the bank have asked the Financial Services Authority "FSA" to SUSPEND THE NORMAL TIMETABLE FOR DEALING WITH BANK CHARGES COMPLAINTS. Once the legal proceedings between the OFT & banks finish, they will resolve my complaint asap.

    Should I continue as usual and wait until I get to the court stages? (seems to be the right option)

    or wait for the bank and the OFTs decision? hhmmm.

    Well your complaint is at least logged and when this fiasco is resolved your complaint should be swiftly dealt with, my concerns is the amount of peeps complaints and how long the bank will take to settle when this test case is over.
    Unless you have severe Hardship then i personally wouldnt instigate legal action at this moment.
