    Hello,

    I am a new member to this consumer forum, and have signed up as i feel i need help with my claim to have my bank charges reclaimed.

    I have followed all stages on the martin lewis money saving expert site and have now been advised my claim will be heard at kingston-upon-hull. I want to be sure that my claim is correctly put together, can you offer me any advise.

    It's good to know we are not alone when taking on the banks as it can be a very daunting task.

    I will be very greatfull for any advise. Thank you in advance!

    Default Strike out at Hull Court.

    Hi,

    I have received a notice to strike out my claim for bank charges from Lloydsicon TSB, the reason being "disclosing no reasonable grounds for claim"

    I have been given until 13/08/07 to send an amended particulars of claim, I really need some help to compile this as the legal jargon used in the letter is very confusing.

    Can anyone help please.

    I really need some help to compile this as the legal jargon used in the letter is very confusing.
    Difficult to help without knowing what the Direction says.
    Post the exact wording.

    Hull strikes again, huh.

    As Michael says, please post the judge's direction, but also please post your particulars of claim, I suspect that the problem is that they are too scant, but we'll be better able to advise once we know what you wrote. ;-)

    Apologies to people who I was in the process of helping, I may be gone some time.

    Here are my particulars of claim also. They are scant! but i didn't really know how to word it.

    I had a cheque account with Lloydsicon TSB in
    Willerby and wish to reclaim bank charges
    made against my account 77 12 29 08303760
    between the dates 03/09/01 to 02/05/06.
    The claimant claims interesticon under section
    69 of the County Courts Act 1984 at the
    rate of 8% a year from {date when the money
    became owed to you} to {the date you are
    issuing the claim} of £ {put the amount}
    and also interest at the same rate up to
    the date of judgment or earlier payment at
    a daily rate of {enter the daily rate of
    interest}.

    The direction is worded as follows:
    A. A statement setting out particulars of the breach of contract and any explanation (if such a breach is alleged). The statement shall exhibit a copy of the relevant bank term.

    B. A schedule showing how the amount claimed has been calculated by reference to the individual item by description, amount & date.

    C. In the event that the claimant is seeking to claim for charges that have accrued more than six years prior to the issue of the claim, to identify such sums and to file and serve brief reasons why such charges are being sought.

    D. In the event that the claimant is seeking to claim reimbursement in respect of interest charged on any overdrawn amount, the claimant is to identify such sums and set out in brief the reasons why such charges are being sought
    OK
    A) is your Particulars of claim

    B) is your schedule of charges

    C) are you caliming charges beyond 6 yearsicon?

    D) are you claiming overdrafticon interest that relates solely to your charges.

    Hello, I have recieved a letter from my banks solicitors asking me to confirm that i agree to their request for a stay of the special directions hearing on 10th september. They have also sent a letter to the court asking for the hearing to be held until the results of the "test" case early next year.

    Can I refuse? Or what would you advise?

    have a look at my letter on the beckett v Lloydsicon which i faxed yesterday

    Halifax WON X 2, Northern Rock WON, Capital One WON, Marbles WON, HSBC WON

    On the 25th october I will be filing a claim for £175.00 Citicards. Just watch it!
