I had a long battle with Barclaycard to get my missing statements - including complaint to ICO - I now have three lots of them. Essentially, they refunded back to my account the charges back to a level of £12 without my agreement. I wrote and refused this. They are now seriously hassling me by telephone - i.e. calls on saturday nights well in advance of monthly payment dates and the account is not in arrears. I have just sent them off the harassment letter. However, my question is, in doing a court claim do I deduct the amount already credited to my account ?
Make a schedule of charges. Lisr all your original charges in full and then enter the refund as a -(minus) figure on the date it was credited to your a/c
