    Default Leicester Court Date!

    I have today received my court hearing date, 23rd October 2007. I am now quite nervous as I didn't expect it to happen. Any ideas of the likely outcome?

    Will A+L pay up before the court date?

    Or will I have to go to court, if so any hints tips please!?

    Hi Webbo, try not to worry hun.... what are your directions?? Do you need to prepare a court bundle??

    So far they are settling as close to the court date as possible, but that nice judge from Hull has called both A+L and YB into couirt to justify themselves, something we know they cant do, so were all hoping everyones fight will be over soon Lets get you prepared just in case

    It is ordered that:

    1. Allocation questionnaires are dispensed with: this claim is allocated to the small claims track

    2. The claimant shall by 17 aug file and service:

    a) A schedule setting out each charge repayment of which is sought, showing the date, amount, and alleged reason (if any) for that charge being made;

    (b) copies of any statement or other document relied upon as showing that each and every such charge has been made;

    (c) A statement of the claimants own evidence, if such is to be relied upon as tending to show that the alleged charges have been made, or that they are irrecoverable as penalties


    If the claimant fails to comply with this order, the claim will be struck out without further order


    IS THIS THE COURT BUNDLE? PLEASE HELP

    Your Court hearing date isn't until 23 October ?

    but meantime the judge wants you to file and service
    all information in
    2 (a) (b) and (c) by 17 August 2007

    and failure to comply will result in claim being struck out.

    well
    item (a) is easy enough.
    that will be your itemised spreadsheet - which is already done !

    item (b) an easy one too
    copies of all your Bank Statements showing charges highlighted.
    which you have in your possession

    which leaves item (c)

    Regarding Item C:-
    If I were you,
    I would ring your local court this afternoon, and ask
    how they wish you to file and service this information,

    is it to be on a
    : certain form/document
    or sent in as a
    : Court Bundle along with items (a) and (b)


    It appears that each District Judge has very different views on how he/she is going to deal with the case.
    so each court has a different procedure
    and the procedure is changing all the time.
