I'm well on the way with my case, but I've just found this forum so I'll give a quick run down of where I am.
I've issued court proceedings and have a 'pre hearing review' (whatever that is) at my local court on the 10th September. The banks solicitor has sent me loads of scary official looking documents referring to their defence. They did make me an offer which worked out £1000 less than my claim which I turned down.
Has anyone else had this sort of experience? Did they win? Any help would be appreciated..
Never gone to court, but I will offer some advice.....if you have a review and don't know what it is, then I suggest you do find out what it is There are LOADS of guides in the library and helping hands around, head over the success forum of RBS to see what other people have done. Two particularly drawn out claims that I was keeping an eye on were by HydraUK and mcuth, should be able to find them with a bit of advanced searching. Have a read through them to see what the court process is like.

I checked out the cases you mentioned. They looked painful.. And long..
Here's my main problem. I am due to leave the country on the 16th Sep. This has been going on for so long I though it would be over by now?!? It looks like its going to go on for quite allot longer. Do you think it would be advisable to make them an offer to settle without the interest, just to get it over quickly? I tried to look for some ‘nudge letter’ templates but had no luck?
Whether your case ends up dragging out or not really depends on what you are claiming for and how much you are claiming for.
Remember, RBS are working to their best interests - if it isn't worth their while defending your claim, they will look to settle. The fact that they have attempted to settle already is a good sign. A lot of people seem to make good progress by contacting RBS directly. There are a few email addresses around the forums of staff members, it might be worth trying to locate these though I'm not sure if they still deal with offers once you have filed in court.
Personally, I wouldn't let them off with anything but the 10th is quite close to your leave date so I guess it's a judgement call on your part. You still have plenty of time.....8 weeks? There is a template around somewhere asking them to settle and save everyone a load of time and money but I can't remember where. Is it a permanent leave or is it temporary? If it's temporary it might be worth your while discussing this with the court.
Would be interesting to hear how much (roughly, don't make it precise) your claim is for, broken down by charges, interest, statutory and compound just so we know what we're dealing with.

Thanks very much for your help. This money will really help with my relocation.. I'm intending to move away permanently which is why I'm feeling a bit twitchy at this stage.
I'm claiming:
£4376.87 in charges
£549.41 in interest
£120 court costs
Totaling £4926.28
I thought about settling for the charges only £4376.87 to end it quickly.
Well it's a decision only you can make. Is the "interest" you refer to there overdraft interest? As in the amounts that have been debited from your account on a monthly basis? If so, have you not included statutory interest? If you file a court claim you are entitled to claim 8% statutory interest, this should swell your claim by a lot. You then need to consider what you are going to do. There is a huge difference between writing off 600 quid and writing off 600 quid plus statutory income.
That said, everyone's situation is different. Like I said, you need to weigh up your own situation and decide what is best for you. If you need to have things done and dusted by September then you may have to look at settling for less that you're entitled to.
I can't see how bargaining with them won't make them sit up and do something about it. At the end of the day, your claim is not an amount that is worth them fighting (IMO) so you would have thought they would be interested in settling.

I noticed that I've got a £10, £5 and a £4 in the first account. Maybe these are genuine charges which is a bit worrying. Could they throw it out on that basis?
They did offer me £3700.00 which was a pretty good first offer looking at some of them. Over a grand shy though..
Like you said though, you've already added 8% so don't really need to see the Breakdown anyway.
Like I said, this is a personal decision. You need to weigh up your need for the extra grand against your need to settle this within the next 8 weeks or so.

I thought I'd say I would settle for the charges without the 8% and court costs for an early settlement. A loss of £700. I have so much to do before I go, it would be another thing off my mind. I would love to stay and fight it out though.
