    Hi there.
    Just registered as member so I could join in. Been reading all the forums and already found them a great help and always nice to know im not alone!
    Anyway so far i have sent the data protection letter to Abbeyicon and received 5 of the 6 yearsicon statements requested with a letter stating I will receive final year within next few days. Once that has been received ill be sending of the letter asking for my charges back and no doubt thats where the fun begins! Will keep you all informed and hopefully as it progresses will be able to help others claiming as well. For info my charges are (approx - need final yr statements yet) £1500. Not the highest claim ive seen but certainly worth my time i thought!

    Best wishes with your claim Hootcube, the £1,500 is better in your pocket than theirs. Always remember it's your money and if you stick to tried and tested methods on this site, you will get it back.

    Keep on their case about the missing statements, maybe phone or email the data protection department at the end of the week if you have not received everything you are waiting for.

    I won against MBNA, Nat West , Barclays, Barclaycard and PPI payments from Barclaycard
    Abbey National still to go.... what will I do with my spare time?

    Thanks for comments. Feel much better about it all whenever i come on here!
    I was planning to call them Thursday if i havent heard anything about the missing statements. Out of interesticon Ive heard a few people say they sorted out their claims through a letter to financial Ombudsmanicon (spelling?) reporting Abbeyicon for making the unlawful charges. Any idea if this is a better option than court? Im actually quite happy to go to court if thats neccessary but is ombudsman viable option?

    Hi, Hootcube.

    After some Scottish courts started throwing out multiple claims on the same account. I contacted the Financial Ombudsmanicon Service. This takes longer to settle than going to court, but I believe they have a 100% record of recovering Bank Charges. Here is their web site....

    I emailed Abbeyicon as you suggested and amazingly recieved an almost instant reply saying it had been passed onto relevant people to deal with. This i took to assume means go away we arent playing. However as it goes i have all the statements i need as the most recent 14 months (the ones which are missing) only have charges on which ive already had refunded (long story how but in the end they accepted shouldnt have been added on in first place) so for the £1500 from the previous statments im planning to write tomorrow to ask them if they fancy giving them me back! Is this ok to do or should I wait until I have all the recent ones as well, as in will this affect any future argument in court?
    Also i hear/read on this site that Yorkshire Bankicon are now having a test case coming up in Sep? Is this still the case does anybody know?

    Well if you are sure that there are no more charges that havnt been refuunded on the missing statements, then feel free to start the process, if you go via court then you can claim the 8% S69 interesticon, if you go via the Ombudsmanicon, i dont think that you get it, so the choice is up to you

    Excellent. Think ill print off the letter now then asking for money back. I am 100% certain no more charges left on missing statements anyway as ive hardly used the account at all in that time (switched bank after Abbeyicon annoyed me one too many times). Good point about the 8%. Not a great amount of money but i dont want Abbey to feel they have got away with something so ill probably go the court route if only to annoy them!

    Ok...latest update is that I sent off initial letter asking for charges to be paid back. They only recieved this yesterday but surprisingly responded immediately and this morning I have letter saying "sorry you felt need to complain, we will look into this and get back to you within 4 weeks to let you know how its going".
    So im guessing from reading other posts i just ignore this and in 14 days send the lbaicon?

    Help needed.apologies for asking so much but im bit lost/confused and not sure what to do next! I sent lbaicon and now the 14 days are up. Im guessing i start the court proceedings now? If so is there a link anyone can provide explaining how to go about this as ive been looking through and have read a few different things really.
