Hi All,
starting this for Sis in Law(L).
Just a quickie, is it OK to claim for Cleared transactions @ £10.00. She has got plenty of these.
In addition, she has got a lots of CASH ADV/CHQ HANDLING FEE £2.50. on her statements. Can we claim for these and or does this support the argument that any figures above this are disguised penalties?
Have Barclaycard shot themselves in the foot by stating handling fee£2.50 on thier statements?

You can't claim back the handling fees. These are clearly stated in the T&C's and what they are for. She would also have been advised by ATM that a handling fee may apply

could U please sort it out
I have two SIS in Laws (L) & (T)
Both have threads under Barclaycard differnt accounts at different stages
One has thread under Abbey also(About to issue N1 Notice)
One has a thread with Halifax(preliminary Letter)
Oh and by the way did one for missus with Lloyds TSB (N1 aq ETC just recieved an offfer)
Oh nearly forgot the one I forgot about for my self. MBNA reminded me with an offer.
So you see they only rick I made was quoting a cleared transaction,originally from Abbey statement in a Barclaycard Thread. I then went to my Sis in Laws Abbey thread and posted the question there.
So to clarify my Sis in Laws thread(L) & (T) are entirely DIFFERENT THREADS
Please look at the titles of the threads
Any chance of putting it right

quick update on two different threads that have been merged by Bookworm
Biffs Sis in Law(T) V Barclaycard
1.Suject access Request sent 14.07.07
2.Stetements recieved 1.08.07
3.Request for repayment letter sent 14.07.07
4. Recieved a statement from BarclayCard dated 17.08.07 no letter just a statement stating
"Dear Miss xxx Your new balance is in Credit
Pleas be aware that there is a credit balance on your account of £xxxxx(50% of the Total of the claim?), therfore you don`t need to make a payment this month. If you want us to arrange a refund for you please contact Customer Services
If you have any queries about this statement, please contact us on 0870 154 0154

Little bit strange to make an offer in this form?
I think we will have to send "Response to settlement offer" letter accepting as part payment etc.

In order to avoid Litigation against you, I am prepared to temporarily accept the sum offered as partial settlement on the clear understanding that the remainder is paid within the next 10 days. Failure to comply with this request will result in legal action against you for full recovery.
If you do not accept my conditions for acceptance, or you do not respond within 10 days, the money transferred to my account should not be viewed as my acceptance and I hereby authorise you to remove this sum accordingly.

This is the second, approximatley 50% of total charges offers,I have had in as many weeks . This and Halifax, I wonder if this is a ploy by the Banks,while the test case is pending, to offer 50% of claim?
Would welcome any views on this and my post in general
