Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Ok having successfully won my charges back from YB I want to get them back from Egg now .
I have a credit card and loan with them what are my options? What can I reclaim?
I have got a statement of my loan but the input on it doesnt make sense at all, it has "payment reversal", "Fee assessment" and "DCA payment" what are these?
I have asked for my CC statements but theyve only sent me 2 years worth. I have been charged substantially .
"I am more than prepared to repay any money I have borrowed, IF they are prepared to refund any money THEIR agreement doesnt allow them to charge me." Tamadus
DCA payment - is that payment made by loanholder to Egg via debt collection Agency?
Payment reversal - did the amount match any previous payment which did not quite clear?
Don't know what Fee Assessment was, what was the amount?
Egg's Late Payment and Overlimit Charges used to be £20, then from about July or August 2006 went down to £16 being the threshold figure below which the OFT would not prosecute them.
If your 2 years worth of CC statement have in your view omitted other reclaimable charges beyond those 2 years, you are entitled to request ALL statements by SAR and payment of £10. The actual Penalty Charges and monthly interest ACTUALLY debited owing to the Penalty Charges can be reclaimed.
Egg does not make a song and dance now (did last year). So long as your final reclaim figures are accurate, and you use moc1982's template letter, you should get full refund very quickly, judging by the experience of numerous happy claimants in recent months -- see V-E Day thread.
DCA- I presume they are called in at anytime and they dont take over the debt, as I had been making regular payments. the figure was £20.
The payment reversal is immediately after a DD payment and corresponds with the figures albeit not always in the right chronological order.
Fee assessment was £20.
I have charges listed in one column as "other" I presume its the PPI i never asked for and theres a first charge of £1919.60 and there after £20 for a while then it jumps to £60
I have asked for my statements S.A.R and they sent my cheque back with just 2 years of statements
So it looks like Ill have to do it again, Im getting nowhere with the internal mail.

Could that "payment reversal" being the reversal of a D/D payment (clue, same amout as the credit D/D amount which preceded it shortly) which was refused by the paying bank? If so this reversal cannot be reclaimed, not being a penalty charge. If the D/D amount just happened to be £20, then understandable if it gets confused with penalty charge also at £20.
Not sure what "fee assessment" was? Unless you could guess, relying on the transaction activities shortly before said item. In the last resort Egg is obliged to explain it. Would be a better bet to write to the organ grinder rather than telephone monkeys who apart from not having a clue could upset you.
If you have not received all the statements you need it is more likely due to muddle than conspiracy, as Egg have been very conciliatory indeed for 6 months, towards charges and interest refunds, better I believe than any other card or bank. If you write to the head man at the address shown in the Egg Stickies, you should get prompt action.
PPI is a wholly different and difficult subject, here Egg will fight to the last drop of blood. Only ANNAlh has won on this, read Angry Cat and Yasmin from V-E Day Index for their First World War trench warfare on PPI, still ongoing after a year.
Im not sure where to go with the loan, from 3rd may 2006 to 29th march 2007 my balance has come down by £5
I have paid in that time £56 so for some reason the interest seems to be static and all these listed transactions are just virtual money going in and out but not making any difference to the balance.
Time to shut up ? or just claim back the PPI?
Im disgusted im both unemployed and on the sick and cant claim for either .

Suggest you IMMEDIATELY try to cancel the PPI in writing and by Egg Securemail starting NOW, at least no further debits get added onto your Egg Loan account thanks to PPI -- if that's what they are. You are entitled to get an explicit explanation of what each debit item was. Egg managers can at their discretion reverse out certain penalties manually and flexibly without too much paperwork, which for sure nobody else outside of Egg can.
As for retrospectively voiding PPI, and challenging the formal legal agreement at inception, that's a vast and difficult subject, check out Angry Cat and Yasmin's threads in V-E Day index. To my knowledge of the numerous persons who tried, only Annalh to date managed to partially rollback a PPI.
Thank you, How would i go about disagreeing that my PPI was without my specific consent.
Is there a template or walkthru ?

There is a separate PPI forum with 517 threads. Even within the Egg forum the PPI threads could form a PhD thesis, try ask Angry Cat. To my knowledge only Annalh managed to get partial success rolling back PPI, with at least half a dozen still trying, some for over a year -- so not to hold your breath.
Not sure why, while both unemployed and sick, your PPI terms will not permit you to claim insurance. Have you not been off long enough?
If retrospective cancellation of PPI is not easily achievable, at least try to limit damage now by stopping further pointless haemorrhage of funds?
I cant claim sickness because depression isnt covered and cant claim unemployment because they will only pay you when youve been claiming JSA for 8 months
Thanks for your help so far

Good news. Happy to report my previous statistic that only Annalh won against Egg PPI missed out the above success on 19 June 2007 after a 16-week campaign.
The CAG engine is quirky. When I did an Advanced Search for "Egg" anywhere in the PPI Forum it failed to find a single occurrence, when in reality there were at least 10, but alas only one success reported.
A PPI **WON** Forum would give encouragement to claimants in this difficult battle. Any chance, Mods?
Empire's was such a rare and significant victory that I have added his 19th June 2007 winning link from the PPI Forum into the V-E Day Roll of Honour (Empire the first claimant to score twice), so the latest score now reads:
S.A.R sent off this morning for both my loan and CC I'm also sending a CCA for both.

Got my statements and im wondering, as i have issue with the charges and PPI should I treat them seperately?

Ive received duplicate copies of my statements
I must have shouted too loud and scared them
Anyway The help I need is, when i first took the card out Jan 02 I was paying plain old interest at 1.093 per month even though I was purchasing goods with it. Then in Oct 04 I started being charged merchandise interest at 1.313 pm and cash int at 1.736 pm. Ive no recollection of ever being informed of any changes and am wondering if anyone has noticed this change?

I recieved my loan statements they are an excel spreadsheet on headed paper, no additional id numbers.
Ive transcribed them into excel and the numbers dont add up.
Suggestions please?

In the same way that they do not send out statements, Egg do not send out anything else. I have not read the fine print of the original contract to get onboard. No doubt there were announcements made on Egg's website, which I remember was a jungle to navigate.
Egg's monthly interest rates have been rising in recent years, and I believe now exceeds 2% for purchases interest, no doubt to compensate for their reclaim payouts.
There are many sharp observers in CAG who do follow the fine print. If it were unlawful for Egg to raise rates without physically sending out paperwork, I would think someone would have raised the issue before now.
