    Default Credit Card Company Lost My Credit Agreement.

    Hi Folks
    I was wondering if anyone could help me with this little dilemma or if anybody had heard of anything similar and knows where I stand.
    Right, so a couple of months ago I rang my credit card company to cancel the payment protection I was paying, they agreed and said they would send me something to sign to confirm the request in writing. A few days later a letter turned up from the CC company but it wasn't a simple letter to confirm this cancellation request.......the letter read.

    "Thank you for your recent request to cancel payment protection

    Due to an administrative error, it would appear that we have been unable to locate your original application form for a XXXXXX credit card and we are therefore unable to verify your signatureicon. This is a requirement for all correspondence received by us. We would kindly ask that you complete the form and return it to us in the envelope provided."

    I didn't sign this letter when I received it as I didn't think something was right but at the time didn't really have time to think it through further but now on reflection (and due to the fact that they are trying to get hold of me twice a week and sending multiples of this letter) I think the bank are seriously in the wrong on this one with regards to the Data Protection Act 1998 and alike.
    I would appreciate it if anyone knows where I stand legally on this and knows what my next step should be.

    send them a letter stating that I DON'T ACKNOWLEDGE YOUR DEBT and thats it.

    Thank you for your letter dated xx/xx/2008 the contents of which are noted
    In your letter you make reference to requiring my signed authorisation before you comply.
    If it is for Data Protection purposes then i can happily supply you with documentation to substantiate my identity to you.
    However please note that to date you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this?
    As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:
    7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal dataicon and against accidental loss or destruction of, or damage to, personal dataicon.

    Send them a CCA request - if they can't provide your agreement then the debt is unenforcable at law
