I have been told I will get all of my cliam refunded (over 7K) but it is going straight into my loan that I hav with RBS.
Can they do this?

i would ask them what do they think they are doing? legally its you money to do with as you please.
It shouldnt affect the T&C of you loan...
they just dont want to give up your money... simple
