    Default Alliance to defend

    Hi There everybody,

    Followed all the steps to to reclaim charges from alliance and leicester, But now at the court stage. I have received a solicitors letter with an acknowledgement of service giving me notice they intened to defend.

    Could someone please tell me what will happen now and what is the chances of me actually having to go to court.

    Hello,

    Have they just acknowledged the claim or actually filed the defense? Some times A&L acknowledge then forget to file the defense and pay up.. Other times they will file a defense, in which case you may or may not get sent an aqicon

    Either way you will not go to court, they will pay up before then!

    i have'nt had my court date but the A&L have put in their defence. and i have had a copy from the court of the defence. i am now paying out the other £100 to go with the aqicon on tuesday.

    it seems their is alot of us at the same stage altogether. i have counted 5 so far. so i would like to know who wraggle & co are to defend them all especially if they are at the same time.

    mine is the same as lesh45's and another one I read on here, if they are going to defend then they will be up and down the country at all these different courts very strange. I haven't got my aqicon yet but expect it this week sometime.

    I am not sure what the £100 is actually for, but its the fee for the allocation questionnaire. You can claim that money back as well (some of the other threads have spoken about that)..

    I have just spoken to the court I have to have my aqicon in for the 17 May so am doing it today he said just to print it off online and take it in

    Hi everyone,

    Received alliance defence papers today from there solicitors, but have also received an offer from alliance on the same day £848. Its only £2500 short of what they owe me.

    Well that was cheeky of them...! Do they really think your going to give up now?

    Template 5 and 6 covers the scenario depending on whether you got the letter from the solicitors or the bank.

    Sadly you will have to part with the cheque for now...to go on.

    With the allocation questionaire you have to pay a cost to file.

    THE aqicon FEE OF £100 (IF CLAIM OVER £1500) IS STILL PAYABLE (AND RECLAIMABLE FROM THE BANK). The fee is payable within 14 days after the despatch of the notice of allocation to track (County Courts Fees Order 1999 Schedule 1).

    For some reason, not everyone gets an AQ from the court, (may be geographical!), so don't worry about this.

    No i have not received the aqicon yet. The whole thing seems to be crazy i have a defence from solicitors stating all the reasons why i wont win in court yet i kind of have an admission from alliance and leicester with the offer they have sent me. They have also threatened to close my account if i don't except the offer. Bring it on im not going to accept!. Have sent them letter back telling them so and also making them aware of the extra £100 it will end up costing them if i get a AQ. The only thing that worries me is that i also have a loan with them, Does anybody know if they can cancel loan agreement as well.

    They shouldn't touch the loan as it isn't the account being claimed against. If they did it would be totally retaliatory and you'd have good grounds for complaint!

    Hey guys,

    Seems i am at the same stage as you. I received a cheque of A&L for £122.50 when the whole lot amounts to £948 !!
    Rejected this obviously ! and have just received Defence papers from Wragge & Co listing all the reasons why i wont win in court. My moneyclaim online now says it cant go any further and will be transferred to the appropraite court.
    I was really worried about actually going to court untill i read all the threads on here as it looks like they are doing this with everyone.
    I suppose i will just have to wait and see what happens next

    Default Can I claim more ?

    Hi Everyone,

    I went through all the procedures of reclaiming charges from alliance & Leicester. I am currently waiting for a court date to be set. But whilst all this has been going on Alliance has added more charges to my account. Can i now add these charges on to the total ammount i'm trying to recover or do i have to stick to the amount that I originally requested firsty to A & L and then to there solicitors.

    Once you have filed at court the only way to add more charges is to fill a N244icon at court, and it will cost £35, which is non returnable, also it can delay your case for a few more weeks.

    You can alway put another claim in later.
