Hi all.
I've just received my list of charges (£437) from Smile and am about to ask them for my money back. I just wondered if it is ok to send my request for the refund of charges by secure message or is recorded delivery the best option? Also, I calculated that they have had another £100 approx in interest from me. Should I ask for both straight away or maybe agree to let them off with the interest of they settle up quickly, ie, 'If you cough up the charges straight away, I'll forget about the interest'?
Any advice appreciated.
Derek.
I'd advise sending your prelim and lba by recorded (or special) delivery.
With regards to the interest, is this the general overdraft interest applied to your account? If you've worked out the interest properly and it forms part of your claim, I'd be inclined to say go for the full amount as opposed to offering to reduce for a quicker settlement. If it's the s69 8% interest - this can't be reclaimed at prelim/LBA stages as it can only be awarded by the courts.
Hi Hedgey, thanks for your reply. The interest I mean is the 8% interest. I have read elsewhere about only being able to claim that in court, but just thought the threat of paying interest may 'encourage' them to pay just the charges with the minimum of fuss.
I was going to say to them that if they just pay the charges quickly I would 'let them off' with the 8% interest.
I may as well just go for the charges though I think. Smile seem to be quite reasonable in dealing with peoples' claims from what I've seen on here.
Thanks.
I sent a secure message requesting my fees (£776)back and within a week i received my money. I did however phone them on a couple of occasions to check how far they were on with my request.
Thanks ebd. I've sent my claim off today by recorded delivery. A week would be great but I'm in no rush really so I'll just wait and see what happens now.
Cheers.
Deek.
