Vikface v Abbey *AQ reply problems... Please help!
Hi,
I have been reading threads for more months then I have been fighting Shabby for and would like to say thank you to everyone for the info on this site.
I have followed the the procedures and have now received the aq (N149) which I have mostly filled in using all these very useful links.... I'm just not sure about section G and what to send them.
Also I'm abit stuck when it comes to paying the £100 fee... Do I have to hand deliver the AQ back to my local court? How do I pay the fee? By cheque? If so, who should I make it out to? Could I pay by card? Do I get a chance to get this money back? If so, how?......
Ahhhh, as you can see, I'm completely clueless about the court process and what to do now... :-|

Hi,
Yes take your aq to your local court as I assume that it has come from there. You can pay the fee by cheque or cash, cash would be best if you can, if you have to write a cheque just go to your local court and ask them who to make it payable to.
And finally yes you will get this money back, add it to your claim.

I have now sent the aq form back to the courts along with section G - other infomation, draft order for direction and the £100 fee, I have also sent a copy of the above to Abbey with a letter giving them one last chance to pay up.

Hi Vicface
You can simply post your aq to the Court, with a cheque payable to H.M.C.S. (which stands for Her Majesty's Court Service) - thats what I did with my claims. You will get the Allocation Fee back (assuming you're successful!) - the Court will add it to the value of your claim. If you want to pay by card, phone the Court and ask them how - it certainly is possible.
I seriously suggest you do a lot of reading before going any further - you really do need to understand the whole process before embarking on it. The best places to start are here -
Reading and understanding all that really will help you - in fact I would regard it as absoloutely essential!

Hi Vicface
You're most likely to get a 65% offer first, then a full offer just before the Court date. That seems to be how Abbey work - they push you all the way to the door of the Court, bundle and all! There again, things can always change, and I'm very much hoping they do before I have to do the bundle for my claim (Tish vs Abbey).
If you do get an offer that is for less than you are prepared to accept, then there are letters here that you can use for rejecting that offer -

Thanks for your reply, I replied to Shabby's 65% offer on June 18th and then rec'd my AQ last week.
Since then I have written back to Abbey with a copy of my AQ and the two other pages (Section G - Other information & something else ~ I can't remember right now!), with another letter reminding them of my recent rejection letter and confirming my reasons for my rejection and confirming that it is now in the court process and that I would reccomend they pay up now...
This was sent recorded delivery on Monday 9th July (I was up till 4am Monday morning doing it so work suffered! ), the same day that the AQ was sent R.Delivery back to my local county court (Bournemouth).
I really do hope they settle in full very soon as I really don't want to do a court bundle or go to court, and to think; this time a few weeks ago I had never heard of a 'court bundle'!!

Bl***y Abbey indeed!!!!!!!! Sounds as though you've done all the right things with your N1 and aq. What happens next will depend on the Court's response to the AQ's from you & Abbey. 'Fraid I have no knowledge of how Bournemouth Court tends to work - perhaps someone who does will read this & give you some idea of what to expect.
In my case I've an Allocation Hearing in September where the Judge wishes to consider making it a Test Case (in common with how most Courts in Suffolk & Norfolk tend to work) and I'm hoping Abbey capitulate before that hearing, which would save an awful lot of work!
In the meantime I'll keep a close eye on your thread - if you need any help or advice, just ask & we'll do everything we can to help.

Thanks for your reply, I have read with great interest your thread (and the othe rlinked ones, as well as many many others!) and wish you all the best for your up-coming test-case, here's hoping Abbey will give in quickly to save themselves the embarrassment of the whole thing.
I was wondering if any newspapers would be interested in your story?
Actually I do have a question.... I have read that I can claim 8% interest (which I did on the previous six years via a 'moneyclaim' website calculator and sent to Abbey months ago), the question is, can I continue to claim this and how would I go about doing this? Would I have to redo my spreadsheet so that it is up-to-date? Would there be a problem in later submitting a higher amount then I put on HMCS Money Claim website when I initally put the cliam in?
Phew... sorry to spurt it all out in one!
Anyway, I'll keep an eye on what's going on with you & cheers for the support.

Vikface, your spreadsheet should keep a running total day by day, every day that you open it up it should be a different amount (increasing LOL) basically, the total that you claim for on the day that you file your N1, or MCOL multiply the total x 0.00022 and this will give you the daily rate that it will increase by and this continues until the day of settlement.

I just wondered if someone could offer me further advice...
The date for the aq is up on Monday 16th July (tomorrow), I just wondered if I could call the court next week to see if Abbey filed their's, if not is there anything I could do? Does it have to get as far as the court bundle? And is Abbey have not done anything does that mean that the court can do something?
