    Default daveasda v Abbey

    hi all im new to all this just decided to take on Abbeyicon i need help with the addresses i have sent my 10.00 for my statements to the data protection manager at abbey house in grafton gates east in milton keynes hope that is right the next stepwhen i get them what address do i send the request for them back to is it the head office or my local branch anyone know also when they refuse as im sure they will who do i send all the following letters to hope someone can help thanks dave

    Default court bundle help

    hi im new to all this so any help would be fantastic im with Abbeyicon the stage im up to is ive just sent them a summons firstl i put the address of my local branch was i correct in doing this also i keep hearing about court bundles has anyone any idea what they are and what the court will need from me i want to be one step ahead of abbey thanks guys

    Hi Guys

    It would probably be quicker for you if you go via Abbeyicon's registered address in triton square london.

    a court bundle is basically everything with regards to evidence etc you are going to use if and when you actually get to court. You will find various links through the templates etc. It is vitally important you start looking at this info and tailoring it to your own circumstances especially with what is happening in birmingham and hull.

    good luck with your claims and don't let them get away with it!!

    there is a template (i think from memory it is in the bank template library) which says Basic Court Bundle, it is not a complete bundle, you also have to put things in that you feel are important and relevant but it is a good starting place. The likely hood is you will never step foot in court, but by starting it, it does give you a sense of achievement. I am only at the sending the lbaicon stage, but I have already started to compile my court bundle. You really do need to be prepared for anything that Shabbey throw at you.

    Hi, daveasda, before you start worrying about your court bundle, I'm not sure by your post what you mean by sending them a summons. If you mean your preliminary letter you really need to read the FAQ's and as many threads in the Abbeyicon forum as you can. If you mean you have just filed your claim, try reading through these step by step instructions which should help you gain a real insight into what you will need to do in the coming weeks/months and the order things are likely to happen in. You may not even get to the stage of submitting a court bundle (finger's crossed!) so try not to worry about that just yet.

    The most important thing is to really read loads of threads on here and look at the templates. Try not to worry about things that are going to happen too far in the future, concentrate on the next step and keep posting before you do anything so that people can see what you are doing and hopefully prevent you from making any mistakes!     thanks everyone for your help ill keep reading the threads the stage im at is ive just paid my money to the court for them to issue a summons i just want to be prepared for what Abbeyicon will do next im a little scared but not scared enough to back down anyone got any links to the templates i need for the court bundles i want to be one step ahead of abbey i have downloaded a zip file off here do i print it off and send it to the court as part of my bundle along with copies of letters ive sent the abbey thanks for all the help guys can i just ask how long does abbey have to respond to my summons before i put in default form is it 5 days then 14 working days from when i payed 4 the summons sorry 4 being so stupid

    Have a look at the section Examples of Witness Statements / Disclosure by List / Draft Directions / Case Summary .
    I put dividers in mine so that it was easy to reference. I also used the disclosure by list as a sort of contents page. And I did number the pages (You'll be surpsrised how many pages you actually have by time you've completed it).
    There's quite a lot of help in what to put in the bundle on various posts throughout the Abbey section.

    Default abbey goodwill payment help

    hi all id be grateful for any help i asked for my charges back got usuall letters back give us 4 weeks ect so i filed a summons no responce from Abbeyicon till today then got letter saying chargers were legal but offered me goodwill paymenticon of 140.00 am claiming 1500.00 wrote letter tellin them to stick it and still taking them to court but 140.00 is already in my account told them to take it back what do i do now is the money mine to spend even if i carry on with court case letter i got from them didnt mention court case they got till 18/6/07 to defend what do i do please help

    Hi

    I have been led to believe that you need to write to them "without prejudiceicon" letter, detailing that you accept the money in part settlement of your claim and you will persue the balance through the case you have already started.

    If you have a scout round on the site there will be some sort of template letter for you to follow. I also understand that you need to do this before spending the cash, as tempting as it is when its sat there.

    the letter i recived does not mention the words lawful or legal just says my charges were correct well we all know thats not right ive sent them a letter telling them to take money back the letter came from abbeys complaints dept it does not mention the fact ive sent a summons i sent summons addressed to my local branch will i be ok with that they got till the 18 to reply then i win by default i think ill not withdraw the money although very tempting

    Correct me if I am wrong, but I am sure you are able to keep the good will gesture that Abbeyicon sent you. All you need to do is send a letter telling abbey that you except the money as part payment but you going to continue with court procedures for the rest.

    update i rang the clown from Abbeyicon complaints dept askin him about this goodwill paymenticon he said it wont effect my claim n keep it but he then asked for my phone number and said legal dept will phone me ooooooooo im worried not. it seemed to surprise him i had issued a court summons well now they know they got till 18th to respond if not i win cant wait see what there next move will be
