Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have been reading around the site for a while and decided to join the hunt for bank charges after seeing all the success stories and help available.
I have started the process by sending my 1st letter under the Data Protection Act to ask for all my statements for 2 accounts, and a list of any "manual intervention" on my account.
The letter was sent 2 weeks ago and I recieved a response yesterday as follows.....
"Your statements will be sent to you as soon as possible.
With reference to your requst concerning any manual intervention to the admin charges debited, these charges have been processed in accordance with the T&C's of our current agreement with you as a result of the activity on your account. In the event that you breach the T&C's, we will take the appropriate action, contacting customers when appropriate, or handling customer enquiries regarding their account status. When a customer has raised a concern in relation to this process, the decision will be communicated to the customer and where appropriate noted on the account
If you have any queries relating to this matter please do not hesitate to contact me.

Is this a standard reply letter? would you advise waiting the 40 days to recieve statements before replying?
I'd just wait for your statements to come through and if they don't provide them within 40 days from when your cheque was cashed then make a complaint to the Information Commissioner.
As Zootscoot hints, hang on to that letter, it could be very useful. I've jsut realised that I've got that letter too. I never realised that it admitted I'd breached contract! Doh!

I have come home to find a thick white envelope containing some statements. I requested statements for 6 years on two separate accounts and have recieved the following....
Account 1: 2 sets of statements from May 01 - Sept 02 (every statement sent twice)
Account 2: 1 set from Aug 01 - oct 02
Every statement has a £14 unarranged borrowing fee for going overdrawn, so I am hoping this can be claimed back.
Just wondering...do statement tend to be sent altogether in which case I need to get on to them to find out where the rest of them are? or am I being to impacient and should wait for the rest to arrive in due course?
Yes, you can claim back all the £14 unarranged borrowing fees.
Nat West do have a reputation for sending a whole string of tatty envelopes each containing a set of statements
