Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I was seriously looking into making several claims last year, but my time is so depleted currently that I know I wouldn't be able to keep track of the process very well. (2 young children and a very demanding business have knocked all sense out of me).
I came across an advert for this company COMMERCIAL LINK REMOVED who basically claim to do all the hard work, and take 10% at the end. They certainly seem very confident over the phone, and I have spoken to several people so I don't believe it's a small operation. They said they have not lost a case yet out of several thousands, so I would like to know if there is anybody here who have had dealings with them.
To be honest, one of the things that held me back last year was the fact that I have a very succesful relationship business wise with the bank, and this way I would be able to remove myself from the process a bit. Making it less personal. I am perfectly happy with losing 10% for that privelage).
I have in the region of 2-3k to reclaim from charges - outrageously what has prompted me back into action was a recent transgression - i went £40 over my agreed overdraft limit, only to be charged an extra £90!!! As I say though, I have a very high turnover and succesful business account, and do not want to jeopardise this, so I need to keep my hands clean of the hardlining so to speak.
I figure somebody here must have come across this company?
as an aside note.. I have just noticed that the link I put to the company in question has appeared in the post as an advert! I checked this on a different computer so I am guessing they have something in place with this site?!! I certainly didn't type it in like that.
Anyhow.. original questions still stands and the company I am referring to is the company that is stated in the title of the thread... not as it appears in the actual message!
(things like that harm the internet - they really do )
Someone I know is using this company. As you have said before very efficient , I asked friend , they are working on 4 sets of charges for her. She went to this company as she thought the scots law hard to follow as her claims are over 5k for one account. So far there don't seem to have been any problems.
Moneyhelp, I know it sounds like I am giving money away that should be mine, and you of course would be absolutely right, but at 37 years old I have learnt a few things about myself, and I know this:
I am pretty much what you would class as obsessive, I have been through this site with an initial light touch, and know what would be entailed to do the job right. I am perfectly capable of dealing with it, BUT, to do it right will cost me dearly in time (I would have to devote a good couple of days in research on this site alone likely, and then I would check and recheck and then redo letters and forms ad nauseum - I will go through my statements with a fine toothcomb and calculate and recalculate etc..) - To do it right I cannot commit to the time. I am a stay at home dad who also works much more than the standard 40 hours a week on my business as soon as mum comes home to have the kids (who are 3 years old and 9 months old by the way - leaving absolutely no chance to deal with this while I have them) - I know there is simply not the time in the day to commit to doing this right. Therefore I am prepared to give up a percentage to get the ball rolling now. My wife's wages have been decimated due to this countries appalling maternity pay, and I am calling in the money as a matter of urgency. I can't and will not wait until things settle down business wise because there is not really any sign of that happening. (Which is a good thing and a bad thing I guess!) If I pursue this myself, I will quite simply come unstuck, and make a mistake. And this is -as far as I can see- how people have come unstuck when this things have unfortunately gone against them in court.
Already (just in speaking to this company) I have seen a whole element that I did not pick up on from this site. Which is this. Considering a bank charge of £20 6 years ago, I am well aware that I would be charging interest at 8% which would be compounded throughout the 6 years. However, this company also reclaims the interest incurred against my further being in overdraft because of that £20 - which is only worked out by the amount of time I actually spent in overdraft since that initial charge (due partly of course because of it!) This angle I wasn't aware of. With o/d interest rates being variable - this will take some working out of course, and I will go round and round in circles. If this costs me - so be it.
Secondly, as strange as it sounds, I do want to distance myself from the process as much as I can, so I can attempt to maintain a good relationship with the business arm of lloydstsb in which my business is extremely reliant on. This may or may not be the end result, but I am willing to pay to give it a shot.
With these companies, it generally depends on how much your claim is worth. If it is a lot of money, expect it to put it at the top of the pile. If it is not worth a lot of money, expect to be put at the bottom of the pile & remain there until the bigger, more money spinning claims are dealt with.
You must remember that these companies exist to make money, that is their only priority.
I would like to add that i started using this company around the time this post was initially made. They have changed the policy without informing me, I thought it was 10% of the total claims. But they have changed this without my knowledge and it is now £150 per claim or 10% whichever is the least.
They did seem quite a good company in 2007 delivering what they have promised at the time.
So far i have had my Credit card charges back via them and the issues only came to my attention because they sent me an invoive. Cheeky buggers have started adding charges for using a solicitor and are claiming they went to court with Barclaycard, then changed their mind and and said it was the Halifax.
I desperatly need some help to stop them going any further as the big ones will be alive again soon (bank charges).
Even going back to 2007 the claim amount was stated 10% OR £150 . It has now gone up to £180.00 I suppose they are just protecting themselves in case your claim is for very little money. Hope this helps.
Thanks for the heads up on the change of charges. They sent me a letter last week saying they were working on my claim so will watch out to see if they charge me the original 10%.
Firstly, apologies for resurrecting an old thread. I used this company to pursue my bank charges claim as I didn't have the time to devote to chasing down HBOS.
Since the Supreme Court verdict, however, I have heard nothing from the company regarding the status of my claim. I've emailed my claims handler several times and tried to phone them on the telephone number given on their website but this just rings out and eventually goes to a voicemail box.
Does anyone know if this firm is still active? And if so, how to contact them as the methods they give on their website don't work.
